Hi I need some suggestion. I came here through brother sister category F4. I came in United States 22nd May, 2010. My elder daughter could not come with me due to her age out issue, and I did not have any idea about Child Protection Act. If we had any idea about it, she was eligible to apply for this rule as she was only 22 years old at that time. We did not have much access to the internet, and my brother who was in United States did not had any idea about this rule.

I applied for my daughter petition in 2011. I applied on 09/07/2011 with the fee waiver form, but USCIS did not accept my fee waiver request. I was facing extreme hardship at that time, and I was unable to afford the lawyer. I did not have access to the internet all the time, and my friends and relative suggested me to wait till you become citizen to apply for her then you should apply and she will come in a year.

We face extreme hardship due to this fact as my daughter was alone in Pakistan. My wife has to come back and forth every year because she cannot leave my daughter alone in Pakistan. As a result, my kids who are with me has to live without the mother. We were living in the extreme fear as Pakistan peace situation is really bad. But we were hopeful that once I became citizen my daughter would be able to come in a year. I became citizen now and I applied for her. But according to Receipt Number, it will cost her another six year.

We as a family are facing extreme mental trauma due to this issue.

I am not sure what to do. Do you guys have any suggestion or if some experience the same thing? Do you think if I write letter to USCIS, they can assign me the priority date according to first petition?

not possible, she aged out and the case was closed when you became a resident

you have filed for her and the wait is over 7 years, there is nothing you can do because others have filed before you and are waiting in line

can she move to another country?

unfortunately your family misinformed you because as soon as you had the money for the i130 you should have filed

the damage is done and you only can wait now until her priority date becomes current

Her PD should be current in 2-3 years under the F2b category.
We as a family are facing extreme mental trauma due to this issue. Separation should not case "extreme mental trauma." That's call normal life. Unless your child is handicap, no one is going to believe extreme mental trauma.
I am not sure what to do. There is nothing you can do. Sorry. Do you guys have any suggestion or if some experience the same thing? My brother left two kids behind when he left. It's been 7 years. Everyone is fine. The kids are adults. Many adult children and their families are in the exact same situation as you. Never a single case of extreme mental trauma from this separation. Do you think if I write letter to USCIS, they can assign me the priority date according to first petition? No.

Come on. Extreme mental trauma? Your adult daughter is 27 years old.

Your daughter's Priority Date will probably be current in 2-3 years in the F2b category (LPR petitioning an unmarried child over 21), she will get a visa then. For now, you will have to wait like my brother and everyone else in the exact same situation as you.

Take the "hardship" and "trauma" out of the equation, as they have nothing to do with it.

Your option is to now file and wait.

November 14th, 2013: She's here!

December 12th, 2013: Picked up marriage license.

December 14th, 2013: Wedding

So your wife visits the US, can your daughter not also come and see you?

I see no basis for a fee waiver or an expedite.

My question is if you knew this was going to cause so much stress to be away from her, why did you move to the US without her? And secondly, your wife has a green card but she is residing in Pakistan and not the US, that is fraud.. With a green card your wife is supposed to LIVE in the US and she should not be using it as a visitor visa.

She visit once in a year ...

People and relatives misguided us that after citizenship if u file a petition for her she can came here within a year ... That's why I was waiting for ...

Come on. Extreme mental trauma? Your adult daughter is 27 years old.

Your daughter's Priority Date will probably be current in 2-3 years in the F2b category (LPR petitioning an unmarried child over 21), she will get a visa then. For now, you will have to wait like my brother and everyone else in the exact same situation as you.

F2B is currently 6.5 years.
