something that clearly goes against the grain of standard operating procedure for thousands of other K1 immigrants./quote]

I was gonna add something snarky like it clearly going against the law, but I have to remember that AOS interviews are also required by law, but may be waived by the Secy of State (or is it the AG?) so that argument apparently doesn't hold water.

I'm surprised by NR's choice, but that's what the DIY is all about--getting the information you choose to get and making your choice. Personally I think that the PR status was coded incorrectly & I wish Mrs Neonred all the best (someone should tell her so she can decide!).

Am I the only one who is reminded (when reading this) of the notices some people recieve that states that their AOS appointment is cancelled? and then low and behold a week later get a "failure to appear" notice? It seems like the right hand is doing one thing but the left is doing something completely different with the USCIS. There is no way that I would trust this. If you do, then thats fab. Good luck to you and the Mrs. I'm sorry but I personally would remove conditions after 2 years and if they say it was unneccesary, well, at least you did what you were supposed to do (plus I believe you'd get your money back). I've seen far too many injustices with the USCIS and I wouldn't put it past them to throw the book at you.

I would cut the card in two and send it back to USCIS with a letter demanding a 2-year green card - and threaten that you will send your wife back to Russia if they do not comply. See what kind of response you get.

PEOPLE: READ THE APPLICATION FORM INSTRUCTIONS!!!! They have a lot of good information in them! Most of the questions I see on VJ are clearly addressed by the form instructions. Give them a read!! If you are unable to understand the form instructions, I highly recommend hiring someone who does to help you with the process. Our process, from K-1 to Citizenship and U.S. Passport is completed. Good luck with your process.

Now I am by no means an expert in this immigration process although the time I been here I should be,

my 2pence worth is get someone with the right authority to give you a letter stating they are well aware they send you the 10 year and not the 2 year card and that you are no longer required to go back after the 2 years

Regards Scotty

Dug of my old post to give an update to anyone that has also had this happen to them.

Today my wife had her oath ceremony and is officially a US citizen. The 10 year green card was never an issue.

We are done with USCIS.

Sent in all docs for ROC, but it was returned to us with a letter saying we did not need to do ROC as we already had a 10 year Green Card.
