Then he needs to leave. I don't see why he believes he has "choices". You do not apply with an unfaithful wife from whom you are separated OR as a back up marry and apply for residency with a "new love". You do not get to fish around for a green card. Through no fault but his own he is currently out of status. Now he is fishing for ways to quickly obtain a green card. No one on VisaJourney is going to help him do that.

He has another love himself, but is unable to pursue it. So there would be no "shopping for a green card". When I say he cannot "afford" deportation, I do not mean literally. I mean he can't risk that happening. He has a job, and provides support for the first 3 children.

So he is currently here illegally.....working

Sounds like more fraud since he has no current work authorization

I know the process is anything but quick. I know he has put himself in this situation, but I feel bad for him and his kids. I can imagine the horror if they are told their father is removed from this country and don't know when he will return. He knows nothing of Haiti or living there. There has to be some way too make this right without him leaving

It's a rebuttal presumption. Not necessarily a conclusion. Kinda depends on who is listed as the father on the birth certificates. And where he was when those babies were conceived.

^^ was my thought exactly. The husband doesn't become the legal father by default if his name is not on birth certificate.

I don't know. I know he worked and went to school here most of his life. Something was done properly for him to have the SSN.

why does anyone care? It's astonishing how many people refuse to abide by our laws, then start asking about loopholes, phony marriages or whatever it takes to cover up their lack of responsibility.....are these really the sorts of people we want taking up space in the US of A?

Inconsistencies in your story:

VJ is the wrong place to come for this kind of help. Being here illegally is bad enough but I doubt anyone here will offer help in committing any more fraud.

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
