Hi all,

I am starting to accumulate piles of paperwork for filing ROC in about 2 -3 weeks and have some questions.

Wife arrived U.S on April 2014 and have been trying to get docs from then on. So far i have the usual ones but did you all submit 2yrs worth of statements from your joint account and credit card? Thats a lot of documents and that itself looks like a huge pile. I have a letter from the Bank that states i added my wife to the account on so and so date. Will that and few statements suffice?

Do you think we need to print out so many statements ( 2 yrs worth) and submit it for ROC? Looking by the way things are going, my application might weigh 4-5 pounds.

Thanks,

Vijay

Thanks. While i understand the impact of weight, providing statements for 2 yrs from joint back account where each statement is 10 pages long looked too much. :-)

So far we have

1) Copy of Renter's Insurance for 2014, 2015, 2015 with both our names added with Address

2) Copy of Auto insurance for 2014, 2015, 2106 with both our names added and Address.

3) Copy of our Apartment lease with our names in it and signatures (electronic and by hand) for 2014, 2015, 2016.

4) Copy of HSA statement that shows Claims for Medical/Dental for 2014, 2015 and till now that shows our names for each claim.

5) Copy of Registration from 2015 and 2016 that shows both of us as owners of the car we bought last yr for wife to drive. We don't have the title because we are still financing it and trying to get a copy from Nissan.

6) Copy of Life insurance policy indicating my wife as beneficiary

7) Copy of her life insurance policy indicating me as beneficiary.

8) My bank account where i added her in May 2014 and statements for each month till now. Each statement is 10 pages and has both our names on it and our address. It does not say who made a transaction though.

9) Copy of statements from Her bank account that we use purely to withdraw quick cash if needed and not much transactions since her pay check just goes there but it has both our names on the statement and our address.

10) Copy of both our D river license indicating the address.

11) Copy of our Costco membership cards

12) Copy of our Amex card statement where she has a card since May 2014 and statements from then on for each month. Each statement is 10 pages long and i have it for 2 full yrs.

13) Copy of our medical insurance cards since she is added to mine.

Pending:

1) Tax transcript for 2013 and 2014 and should get it next week.

2) Copy of the title of the car bought last yr showing both of ur names and address.

3) Affidavit from 3 friends.

4) Photos from trips to Southern california done last yr.

Anything else important that i missed?

We got an RFE for not providing ALL financial documents since the inception of the marriage. I had initially submitted one statement per quarter.

See my Response #6 in this thread from last year: http://www.visajourney.com/forums/topic/572609-what-if-our-rfe-isnt-enough-automatic-denial/

Hopefully you will get a nice adjudicator.

YMMV.

Your list looks good. Consider including wills and/or health power of attorney. Affidavits are secondary evidence and it's ok if you don't include them.

Thanks all.

I tried to do some googling regarding getting getting medical power of attorney and couldn't get very far. All the info i have read suggested going to a lawyer to get this done or use legalzoom. I live in the Bay area (San jose, CA) and was wondering if there is a cheaper way of doing it like filling the form by myself and my wife and submitting it to court without a lawyer? I know some paralegals do summary of dissolution for couples who are married for less than 2 yrs so that you don't have to step in a court room or hire a lawyer and much cheaper for a divorce. I haven't called paralegal services if they can provide similar services for medical power of attorney yet but wondering if there is a cheaper and easier way than spending my hard earned money on a lawyer who charges even if he/she sneezes.

Thanks.

Thanks. I will submit the truck load then. Wish they had a website where i can just upload all the statements which are in PDF format anyway so that they can just view it and not waste paper printing it. Too much paper work. :-)

Thanks,

Here's the healthcare power of attorney for people living in CA. There's nothing cheaper than this since it will cost you zero dollars to download, print and sign it. I don't know the notary costs in CA but that's the most you'd have to pay for doing this. Good luck!

Thank you very much!

I have another question. We are expecting our first kid in May 2016 and got our second scan done (at 20 weeks) and have pictures of the ultra sound. Does it make any impact if i add this to my evidence pool or use it as more bonafide evidence? I cannot mention this in I751 because Kid won't be born by the time we send the application and i am planning to send the application in a week or two.

Thanks.

Congratulations for your baby! Are you asking if you should submit the ultrasound pictures at a later point after you've already submitted the first pile of paperwork? If so, I don't think it's worth the hassle. Having a baby is not primary evidence for USCIS regardless of our perceptions on the subject. But if you have something regarding the birth to submit now, then go ahead, it won't hurt you.

Thanks.

Sorry for not being clear. I haven't sent my application yet and still in the process of putting together everything. We do have pics from the Ultrasound that also shows the expected delivery date which will be May 2016. So was wondering if i should include the ultrasound pics with the application packet that i will send by end of next week.

I wouldn't bother, USCIS (and the rest of the government) will only care when there is an actual birth.

On a side note, we used legalzoom.com for our wills, DPOAs and living wills. It cost just around $425.

Good luck on your immigration journey.

Your list looks pretty good. You can include affidavits or not, up to you. They're weak evidence and you have lots of strong evidence otherwise.

Thanks All.

Dumb question but going to ask anyway. I looked at the "guide" section and found a sample cover letter to send with I751. Apparently that letter is written by U.S Citizen spouse (conditional PR's are husband and Kid). Now the form I751 is supposedly filled by the petitioner (ie: Conditional PR). Is that ok?

Should the cover letter be written such that Conditional PR is asking to remover his/her conditions or should the cover letter be written by U.S citizen spouse? Just want to make sure if it should all be consistent.

Thanks!

In the USCIS-provided I-751 form, there are sections specific to the U.S. citizen spouse or the conditional LPR. In your cover letter, it doesn't matter who signs it. It can be the USC spouse alone, the LPR spouse alone, or both of you together. Technically a cover letter isn't required for USCIS but it just looks professional.

Thank you. I will stick to the plan of me writing the cover letter then.

Almost there to send it out. :-)
