Petitioner's Passport Copy

Hi everyone,

Can anyone here, clarify to me if we might receive RFE because my fiance (The Petitioner) passport copy that sent to USCIS is only the first page which is his Bio Page only and the expiration date of his passport is on 2017 and it says here that petitioner's passport expiration date must be valid for 5 years? I am afraid that we might get RFE and we are hoping that we will receive the NOA2 this month as per my timeline anticipating dates. I have read here that all pages of petitioner's passport copy should be send but we already sent the packet. I have some friends in the Philippines who applied for K1 visa and already in the US, and they said just the passport Bio Page needs to be sent to USCIS. Im quite confused. Also, my fiance (the petitioner) birth certificate is just one page and it has nothing at the back but I have read here that Birth certificate copy should be back and forth.

You only have to send either the petitioner birth certificate OR passport to show citizenship. I sent copies of both sides of my birth certificate even though nothing was on the back either. I doubt they would give an RFE for that. Never of heard of anyone else getting that.

Again the petitioner's passport should be a validity span of 5 years... not that there should be 5 years left on it. Mine only had 3 years left on it until expiration when we applied. Also, again its just to show citizenship. Now many include all pages to show the passport stamps for proof of visiting the beneficiary. Try not to worry. I think you're ok.

You will be fine, mine just showed his front as well and his expires in 3 years the time we did plus provided BC to show proof of citizenship

If you included the birth certificate, then that will work for proof of US citizenship. If you had not included the birth certificate, then you would have received an RFE because to use the passport for proof of being a USC, you must include ALL pages of the passport.

Not really an issue for you because you had the birth certificate, but in case anyone else reading this thread wonders>

The passport needed to be issued with at least a 5 year validity, not that it needs to have at least 5 years remaining before it expires. Passports for adults are issued with a 10 year validity. Passports for those 15 and under are issued with a 5 year validity, so there is really no worry about the issue of validity. You can use it to prove your US citizenship as long as it is unexpired.

From the I-129F instructions >

5. What Documents Do You Need to Show That You Are a U.S. Citizen?

a. If you were born in the United States, submit a copy, front and back, of your birth certificate.

b. If you were naturalized, submit a copy, front and back, of your original Certificate of Naturalization.

c. If you were born outside the United States and you are a U.S. citizen through your "parent(s)", submit:
(1) A copy of your original Certificate of Citizenship; or
(2) Your Form FS-240, Report of Birth Abroad of a United States Citizen.

d. In place of any of the above, you may submit a copy of your valid, unexpired U.S. passport issued with a validity
period of at least 5 years. You must submit copies of all pages in the passport.
