Hello Visa Journey Members,

I need some guidance, here is my situation.

Me and my K-1 applicant fiancée who is from the Philippines received (NOA1) on November 9, 2015. We are currently waiting for our (NOA2) approval. We had our engagement party with her family and friends on September 6, 2015. During my visit my fiancée became pregnant with our child; this will be her first child.

Her due date is June 4, 2016 and we have yet to report her pregnancy to USCIS. It is my understanding she doesn’t need to report it until the Medical and her Interview. We did get an ultrasound report and medical certification from her doctor showing that the baby was conceived during the time of my visit for our engagement party.

  1. Do I need to report her pregnancy now or just wait for the medical and interview? If so, how do we report it?
  2. Is the medical certificate from her doctor showing she conceived during my visit the only documentation we need? If not what else do we need?
  3. We are hoping she is approved for her K-1 Visa before May 01, 2016 what are the odds of this happening? Because she will still be able to fly to US with doctor’s approval to airlines. (Delta)
  4. How does her being pregnant slow down the process, can she still pass her medical? I heard she wont be able to do chest X-ray and a few vaccinations?

Thank you.

The pregnancy shouldn't slow down anything and she really doesn't have to report it to anyone until the baby is out. I was pregnant during my visa process and yes there were a couple of shots I couldn't take which is fine while pregnant to avoid. I wasn't required to get them later either. About the xray....that is all from country to country. In Scandinavia you don't have to do them when pregnant but other countries require them no matter what

1st May seems unlikely, assuming you can pass on Citizenship you will be looking at a CRBA to obtain a US passport for the child.

Why would it be unlikely considering California Service center has been approving current (NOA2) in 1-2 months from receipt time. I'm just worried that her being pregnant will slow things down? Yes, I am an American born US citizen, what is a CRBA? and if she does need to give birth in the Philippines how much time does it take to get the CRBA?

Thank you for your response!

USCIS is likely not concerned about the pregnancy. However, they will likely be interested in the birth.

Check out the CRBA sub-forum and the Phil. Regional Forum for further information.

Good luck on your immigration journey.

You will be just fine. If things continue to go at the speed they have been going and if all goes well, she will be in the US well before May (fingers crossed).

You don't need to do anything except wait and pray for a fast NOA2 approval!

Good luck!

There is no reporting requirement.

There is no reporting requirement but should disclose it during her medical.

We did get an ultrasound report and medical certification from her doctor showing that the baby was conceived during the time of my visit for our engagement party.

Fine, that info is not needed.

  1. Do I need to report her pregnancy now or just wait for the medical and interview? If so, how do we report it? Wait.

  2. Is the medical certificate from her doctor showing she conceived during my visit the only documentation we need? If not what else do we need? Nothing is needed unless the Embassy believes something different.

  3. We are hoping she is approved for her K-1 Visa before May 01, 2016 what are the odds of this happening? Because she will still be able to fly to US with doctor’s approval to airlines. (Delta) Seems reasonable.

  4. How does her being pregnant slow down the process, can she still pass her medical? I heard she wont be able to do chest X-ray and a few vaccinations?

It doesn't.

Thank you.

USCIS doesn't care if your fiancee is pregnant and neither does the embassy, St. Luke's cares because of the medical as they will do things slightly different... after that they don't. Your fiancee being pregnant slows nothing down in the visa chase. For the most part no one cares that your fiancee is pregnant.... except the airlines if she is close to term.

Her due date is June 4, 2016. Our NOA1 date is November 9, 2015, just praying for NOA2 anytime now. She will fly Delta nonstop to Seattle, Washington. Called Delta and no restriction for pregnant flyers, they just recommend getting approval from Doctor. She will be 8 months pregnant May 4, 2015. So this is our hopes to be k-1 approved no later than this date.

Hopefully you have a good medical plan for the birth. That's quite a trip at 8 months pregnant

I'm an operating engineer with awesome medical insurance and of course we are hoping to be approved before May 2015. Her doctor will Ultimately be the one to make the final decision whether she should fly or not. We are planning on seeing doctor prior to any flight plans.

Most plans will not allow adding anyone to a current plan except for a new spouse...so you will need to marry first before your insurance will cover her.

Yes, you're correct! I've already contacted insurance company and she is covered from date of marriage certificate. We are getting married at courthouse after her arrival then after the birth holding a wedding reception with family and friends. Our engagement party was held in Philippines in September 2015, with 35 of her family and friends.
