hello

My wife is a US citizen and I live in Pakistan . We been married for 2 years now she applied for my immigration via spause visa.My wife recevied my NOA2 in august and she did submit all the documents and fee and taxes for the future process.

Npw its been more then 4 months now but we havent recevied any further notification or any kind of letter from USCIS .

We are very worried and confused please help us by explaining . What is happening now and how long its gonna take more for the process to complete.

Has your wife called the nvc?

NO i dont think so because she hired an agent/lawyer and every time she call the lawyer the response just wait 1or 2 weeks more....

I was wondering is it Ok for me to directly contact the USCIS and ask for details.

if its OK can you please give me the contact details...

AL Salam alaikum

The case number is the receipt # you received from USCIS . and sense you have NOA go head and call USCIS / NVC and ask for your case and don’t put all your effort on lawyer some lawyer are useless

Please follow your case by yourself (good luck )

Calling USCIS will be useless for two reasons:

  • They have approved the petition and sent it to the NVC (i.e. they no longer have the file).
  • USCIS won't speak to the beneficiary, they will only speak to the petitioner.

The NVC is a separate entity from USCIS altogether and their contact information can be found by clicking the link in a previous post. Furthermore, the USCIS receipt number is not the same as the NVC case number; however, until an NVC case number is issued, the USCIS receipt number can be used.

Unlike USCIS, the NVC will speak to the beneficiary in addition to the petitioner.

Calling USCIS will be useless for two reasons:

Based upon what the OP has stated, you can't conclude USCIS sent the file to NVC. I had a similar issue, whereby USCIS said they sent the file, NVC never received a file, and after an info pass appointment in LA and an email sent to several senior managers at USCIS, the file was sent to NVC.

(Editing for the benefit of the OP) - you received an NOA2, which simply means your file has cleared the USCIS hurdle. This isn't proof it was sent to NVC. That proof is notification from NVC (Department of State, different government entity). Unfortunately, USCIS doesn't send you a notice they sent the file to NVC. Most people never have an issue (NVC sends you a message they received the file. The problem arises if USCIS forgets to send your file, or loses it. That happened to us, therefore, all of the calls and emails I sent to find the file).

All that took a lot of calls, notes, and planning. OP, if this is your situation (and you won't know until your wife gets on the phone and starts asking), suggest you be organized and patient. Maybe you let your attorney handle (isn't that what they are paid to do), but IMHO you must do this yourself.

What i got understand from all the above talk is that either me or my wife should get on the phone and start calling NVC .

NVC is open today until 31 Dec, Jan 1 to Jan 3 are closed.

Let your WIFE call instead not you. The petitioner should do the calling not the beneficiary.

For USCIS, that is true. However for the NVC, either party can call and it doesn't matter who does the calling.
