My wife arrived in U.S. on 11/20 and we were married on 11/24. My question is, her I-94 expired earlier this month. We were going to apply for the ss card tomorrow. My question is did we wait too long to apply for the card or can we still apply to get a ss card? Wold like to have applied sooner, but my schedule is hectic. Any advice? thanks.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Yes, you waited too long. You needed to apply right after entry, but had up until 2 weeks before the I-94 expiration. Now you must wait for the EAD or green card in order to apply.

Take copy of marriage certificate to SS office and apply

They cannot apply based on the K-1 entry now that their I-94 is expired.

Sadly now it is expired you have to wait till she gets her EAD or Green Card to get her SSN
