Hello.. I seriously neeed help. I was a green card holder but was being removed under Section 237 (a) (2) (A) (i). While in the removal process my wife submitted an I-130 that was approved after i left the U.S. I filled an I-824 to continue with that approved I-139 in the dominican republic. What I'm wondering is any ideas of what i can expect if i get an interview. Would i qualify for waivers? What waivers?

Thanks. any help will be appreciated. I'm a father of 3 U.S. Citizen and married to an U.S. Citizen.

yeah that i understand. I'm looking in my paperwork so i can give more details. My main question is if for the grounds i was removed would i still qualify for waivers? I already know waivers are difficult, but would like to know if i would have a 10 year ban or anything like that. I'm guessing i can probably make it to the interview, and after that see if i need to hire a lawyer?

There is usually a five or ten year bar in play after you are deported, with the difference depending on the exact manner of your removal.

None of this would have happened without a Lawyer.

And with no idea of the issue involved it is impossible to really comment on the specifics. As a general view.

Much easier to avoid deportation than to get a waiver for re entry.

How long ago this happened and showing rehabilitation are usually relevant.

Hopefully your wife answered question #16 honestly on the I130.

It could turn into a bigger problem for both of you if she didnt.

That would be the least of the issues, certainly would not help.

Basically it is much easier to go through the process in the US, delay it for ever whatever , than tp get back in.

He has already been deported, not sure why they didn't request the issue be delayed while the I-130 was pending. Since the crime was serious enough to warrant loss of PR status and deportation I find it doubtful obtaining a visa to immigrate back will be easy. I suggest you consult with an attorney or if you chose not to do this attend the visa interview and see what they say.

I-130 approval? Cool!

That casefile will move to nvc and not the iv unit.

When nvc is done an interview date is assigned.

On interview day, expecting a denial, bring the i-601 in.

Then wait.

Thats my understanding of that process, really.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

That issue was that I got into a fight, the other guy ran and I followed INTO his house to continue the fight. He dropped all charges, but the state picked them up. I'm not a saint, but it wasn't like this was my kind of life to always be in trouble. I actually completed the probation and all recovery programs assigned. I changed and had two jobs to support my family.

I had a lawyer who filled multiples "state of removal" but they were denied. She is asking me to pay $300 so she can give me my case with her that includes that I130. I don't know what she put for question 16.

So I'm guessing all I can do at this point is wait for the interview, but would like to be more prepared for what's coming. I'm going to start to get the papers from that lawyer and consult a new lawyer. However, I'd like to try to get to the interview without paying a whole lot in lawyers since for the waivers it will be a big chunk of cash.

What were you convicted of and what was the sentence and what could have been the mnaximim sentenece.

There has to be more to the story. They don't revoke a green card and deport someone for a simple fight/argument. There had to be some physical violence, serious threats, use of weapons, something more than just chasing him into his house.

You already have the approved I-130 so continue with it and see what happens at the interview. If you are eligible for a waiver they will tell you when they deny the visa.
