I went for interview (AOS from B2) sometime last month, I did fairly well but the fact that my name wasn't on my wife's lease and some discrepancies in our answers about our living arrangement raised all d red flags.. I received a mail saying "intent to deny petition" 2weeks after. The mail basically highlighted that our lack of proper evidence to prove a bona fide union raised doubt on the validity and authenticity of our marriage.

I was given 30days to come up with evidence such as *lease agreement * joint asset * affidavit from family and friends etc and any evidence of old experiences.

My question is this, if I decide to take her away from her current apartment and rent a new apartment with both our names on the lease, would it be a desperate move? Because attempts at including me on her current lease have been futile.

We had a joint acct that was closed by the bank for lack of activity bcos I didn't ve a job then. Will adding her within this 30days to my acct be viewed as a desperate move as well?

I need your candid advice pls!!! FYI, we are in a TRUE relationship I was just poorly prepared and nonchalant in gathering evidence.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Now is time to get an immigration attorney, you've already done damage doing it solo. No offense, you've been a member here for several months now, I just don't get how you could take this process lightly and unprepared after all the stories you see here. Anyway, now you really wanna send in as much evidence as you can, and prepare for a possible stokes interview. Like I said it's best for an attorney to handle it at this stage.

Adjustment of Status From F-1 Visa.

8/14/2014: Mailed AOS package: I-130, I-485, I-765.

8/18/2014: Accepted in Chicago. Transferred to Nebraska Service Center.

8/21/2014: Received NOA 1. I-130, I-485, I-765 in mail.

8/25/2014: Received biometrics in mail. Scheduled for 9/8/2014

9/24/2014: EAD approved. 36 Days!

10/01/2014: EAD mailed.

10/03/2014: Received EAD card.

10/14/2014: I-485 moved to testing and interview.

1/28/2015: Interview scheduled for 3/4/2015.

1/31/2015: Received interview notice.

3/4/2015: Interview completed and APPROVED!

3/5/2015: Welcome notice mailed and I-130 Approved.

3/10/2015: Welcome notice and I-130 approval notice received.

01/23/2019: Interview Scheduled for 2/27/2019.

02/27/2019: Joint I-751/N-400 interview. N-400 recommended for approval.

05/16/2019: N-400 APPROVED! Placed in line for oath ceremony.

05/17/2019: Oath ceremony notice mailed.

Well I dont think the advice you got was wrong-- (submit what you as long as the relationship is genuine). That is the correct advice. Your problem was you didnt do well at the interview. I dont know why your post says "I did fairly well". (?) You and your spouse gave mismatching answers. In no way can that be described as doing any variety of "well".

The advice you got was to submit what you had then prove the rest (or make up the lack of documents) at the interview. This usually isnt a problem for people in a genuine relationship because they give matching answers.

Why cant you get on her lease? I can understand not being able to get on a responsible party but you should at least be able to get on as a registered tenant/ allowed occupant. In all leases Ive ever seen they require a list of the names of the parties that will be residing there. There are rules about how many occupants a rental can have so they likely are interested that you are there and have a procedure for adding you.

There seems to be more to your story then you are disclosing here. If you can provide a list of what you submitted as evidence and more details about the interview it would be helpful in exploring options on how to overcome their finding.

1. Why is your name not on the lease? Do you even live there? You say starting a new lease would "take her away from her current apartment". Is she the only one living there? Why? If for whatever reason you do not have a joint residence, was this explained in a cover letter with your application? If not, was it explained during your interview? There are some missing pieces here.

2. Your joint bank account was closed because you didn't have a job? What a strange reason. Did she have a job and contribute to the account? Something seems fishy here. Did you both not do anything with your joint bank account and then try to use it as proof of a bonafide relationship?

3. Related to #2. You talk about adding her to your account. Which one? Another one that you were using without her? I do not understand how you now have an account on your own.

4. Do you have any other evidence of a shared life? Anyone can say their relationship is real (I'm not doubting your here) but I think the immigration officer was quite prudent in their denial intent. The interview is where you should have made up for your lack of evidence. It is quite common not to have much for the AOS as you may not have been together that long. What kind of discrepancies were there in your answers? I cannot imagine something like "We moved in on March 12, 2013" vs "We moved in on March 13, 2013" would be reason for denial. I would include a lengthy cover letter explaining and apologizing for said discrepancies.

5. You have 30 days to get stuff together. Get to it!
