I am gathering my AOS document and here is my questions,my wife earn only on SSI and we ve a joint sponsor,what document can my wife submit of her back up on SSI even when if her income would not be counted?the joint spobsor have 3kids and her tax return in 2014 is 35000dollas with 2kids,but present in 2015 her earning was increase to 37000dollas with household size of 3,now her employer will be giving her letter of her joining date and current earning of 37000dolla where as she only have the tax return of 2014 with 3500dollas,in this process,are we going to tell the employer to write it in repect to 2014 tax return or whst can we do?what if we submit 2014 tax return and my visa interview is 2016,wont consulate ask us for 2015 tax return?these are the list of document i ask my joint sponsor to make avaluable from a qualified joint sponsor ANYONE

* Affidavit of support with original signture

* W2 form(s) for year(s)

* Evidence of U.S citizenship or status as lawful permanent resident

* Evidence of current sustained income like pay stub

*letter from employer stating joining date and monthly pay.please hrlp if i am missibg something

My joint sponsor tax return of 2014 is 20000 for 2household but she later have an increase of salary to 37000dollas with 3household size .her employer will write a letter for us base on the increase,the 2015 tax return will be out 2016 january,now we want to submit AOS,what can we do since 2014 support is lower and what if i am going for interview next year after aprovah,which tax return can i take along to the embassy?help with the document we need to submit to NVC to get approvah.thanks as i wait for ungent reply

Current income is what counts.

You can use the 2014 tax return, and update with the 2015 tax return at the interview.

You want the Joint Sponsor's tax transcripts which are alternative to a completed tax return. It's easier to use and get the tax transcript from the IRS. Google "IRS tax transcript."

i so much appreciate for your timely reply,but her income in the tax return was below poverty guildline in 2014,but now increase to 37000 which is fine for now

To reiterate on what aaron2020 already told you, current income is what counts and if current income meets or exceeds the figure for the applicable household size, then the person is qualified to be a joint sponsor. The fact that the income figure for the prior tax year was not a qualifying figure is not disqualifying.

thank u very much for the reply.now her current income is 37000 after the increase but 2015 tax return is not yet out.her 2014 is below the guildline.is there anyway we can do about this?

Here is what you do:

  • Forget what the 2014 tax return says right now.
  • Forget that 2015 tax return is not yet out.
  • Obtain a letter from the employer that states what the job title is, rate of pay, and how long the person has been with the company.
  • If the letter is not easy to obtain, then pay stubs showing rate of pay and YTD income will suffice.

Sorry to give bad news but I did just that with alot of proof (letters from employers, check stubs, etc.) that I made currently well above the poverty guideline and they requested a co-sponsor. Unfortunately my last 2 years taxes did not meet the guidelines so they do care that the petitioner did not meet the poverty guidelines for the last two to three years in tax returns.

I returned the RFE and provided transcripts for the last three years for the petitioner and a co-sponsors tax transcript for only the last year with bank statements on monthly total deposits to prove he currently makes above the poverty guidelines and we were finally approved.

Good luck. This was my personal experience as outlined below.

January 16, 2013 - I-129F Petition Sent USPS
January 22, 2013 - Petition Delivery Confirmed
January 25, 2013 - NOA1 Email and Text Confirmation
January 30, 2013 - "Touched" Alien Number Generated
January 31, 2013 - NOA1 Letter Received via "snail mail"

Sorry to give bad news but I did just that with alot of proof (letters from employers, check stubs, etc.) that I made currently well above the poverty guideline and they requested a co-sponsor. Unfortunately my last 2 years taxes did not meet the guidelines so they do care that the petitioner did not meet the poverty guidelines for the last two to three years in tax returns.

I returned the RFE and provided transcripts for the last three years for the petitioner and a co-sponsors tax transcript for only the last year with bank statements on monthly total deposits to prove he currently makes above the poverty guidelines and we were finally approved.

but in my situation,the petitioner which is my wife,only have SSI and she is a full time student,our co sponsor have earning that is above poverty guildline for 2015 and last year income was below the guildline,what can we do at this point?
