Immigration is a 2 way street, something often forgotten ot seems here where many seem to assume it is US only.

Thank you all for helping me and for your concern. I do have a backup plan, that my wife is perfectly fine with, and that is to move with her (in the Philippines). If it comes to that, I want to be able to say that we did our best, even if it wasn't good enough. I agree with the marriage fraud laws and support them; so if she is found to have willingly committed marriage fraud, we will accept it.

As for her intentions, truthfulness, and niavite, she is very carring to all, honest as anyone, and we will be fine where ever we end up.

Thank you kattaklizm, for this info. I will be contacting a lawyer and mentioning this waiver to them.

When I read this post. The first thing I thought was fraud. I show it to my wife who is Filipina, I thought she would think the same but to my surprise she told me she thought the girl was telling the truth. I ask My wife why she told me most Filipina excluding the scammers and bargirls are honest so when the girl was ask the questions at the interview she answer the questions honestly .I ask my wife how is that possible that the girl did not know somehow doing the process, My wife told me if the girl is from the province then her English might not be that good and she just put her name on documents or the guy could of just sent her a blank page that she sign. I mention the medical and that they ask what type of visa. My wife told me they do not mention the visa only immigration or non immigration. my wife told me that most Filippinas from the province do not know the different type of visas or the difference between them. Also the girl technology (using computer) might not be that good. My wife also told me if the girl was really trying to just get to America she would of came up with any kind of answer besides none

So I can see how immigration looks at it as I too at first thought fraud but after talking with my wife I now can see how that could be possible

good luck . You will most definitely need a good lawyer. I think not only will your wife have to prove there was no fraud, You and her will probably have to prove more of your relationship then others

Yes, what you have said is true. She is from Davao; actually, she is from Mawab (in the province). We will be getting a good lawyer, but not sure if it should be one in the Philippines or in the U.S. I'm leaning to the U.S.

I truly believe she is lying to you as she lied to USCIS. She wrote a letter of intent to get married,then do not tell me she did not know.

It doesn't matter if she wanted a better life for her family,people choose other ways to live instead using fraud.What do you expect from someone that tried to scam your Country?

We have hundreds of decisions from the Court of Appeals regarding AOS denied because of sham marriages.You will waste time and money trying to get her here .I know she is not submitting document for AOS,but the l130 will be denied. The punishment is severe.

You didn't ask but here is my advice,find someone's with moral values,because this girl has her moral compass broken. Excusing her fraud attempt is silly to say the least. We have people from poor Countries such as Nigeria Kenya,Philippines,Brazil,Uganda,Colombia etc., that entered here legally.Your girl fraud plan did not work!

I never said it would be easy. I think not only will she has to prove no fraud but they will have to prove their relationship more

The first thing I will do is try to get as much info on the K-1 case especially the letter of intent and see exately ly how it was sign

It is going to be very hard for them but after talking with my wife I do believe thier story is true

also I think the lawyer should bring up the fact that she answer none. What kind of person will answer none to a relationship question if she was jyst trying to come to america

yes but i met they will hsve to prove more

actually I think you have to prove more if you are married anyway and you are doing the cr-1 visa

I don't have advice other than contact a lawyer. This is beyond DIY at this point. You can do a consultation over the phone with any lawyer because immigration is federal. You need a US immigration lawyer, not a Philippines lawyer. A Filipino-based lawyer can't do anything with US immigration.

I actually believe your wife's story. This was 10 years ago. How old was she? Assuming late teens/early 20s if she wanted to come to the US for college. Most Americans are naive at that point, let alone someone who is from a different country. I did my husband's entire I-130 and other paperwork. He just signed on the dotted line, so to speak. I find it entirely reasonable that a scammer could forge a K-1 package.

This kind of smells like human trafficking. My spidey senses are up. We can't forget that there are many, many human trafficking victims who get tricked to coming to the US under the guise of studying or working as a secretary or model. Then they get here and are forced into the sex trade or forced to do slave labor with little or no pay. There's also cases where someone marries an immigrant for human trafficking.

The fact your wife was open about wanting to study, and didn't know about marriage, does make me concerned the original petitioner was looking for naive Filipinas to bring to the US.
