Wow... like others have said you need to really think about continuing to use this lawyer. I don't know what you mean by "videography receipts" but they don't accept anything electronic. No zip drives, nothing on your phone, nothing. Also it's the first rule of VsiaJourney to never set firm wedding dates until the actual visa is IN HAND.

You most definitely need the Intent to Marry letter. 100%. You need it in the initial filing and you need one for the eventual interview.

You need to follow the guides on here because your lawyer is not doing a good job.

Honestly, I've never hired a lawyer for my K1, AOS or ROC. I just followed instructions on visa journey, it's such a good site that you wouldn't need any lawyers or anything. Do yourself a favor if your case is not complicated, save some money. Go through the forum and instructions, it states every thing clearly what needs to be done. Go through the example letters, you should be good. And yes next year I'll be applying for my naturalization and I'm going to save my self at least a $1000 for not hiring a lawyer, wish I could donate visa journey some money instead :)

You may feel defensive and not like what you're reading but that doesn't make us wrong.

You will delay your processing time when you receive an RFE for missing evidence, in this case the Intent to Marry letter.

If your case is straight forward, like neither of you have any convictions or children just consider doing this process yourself. It's a lot, granted, but completely doable. Your lawyer is just going to tell you what documents to collect, you still have to fill everything out yourselves. Everything you need is right here.

What you're planning to provide as proof is also assuming you'll get the visa. That's fared bad for people at times.

Secondly, having agreements with venues and such isn't the same as having one with the government. They hold your word higher than they hold your ability to plan your wedding.

You have to tell the government two things, first that you are legally able to marry, which having a venue and such does not tell them. And two, that you will get married within 90 days which also doesn't tell them because for all you know your case will take longer than normal. There have been people with cut and dry cases who ended up having their case take two times longer and past their planned wedding date.

By giving a statement, you are telling/promising the government that you are legally able to marry and that you will get married within 90 days of entering the country.

The government holds your words higher than your actions.



Note: Some consulates also ask for a second letter of intent, reaffirming that you still are legally able and wanting to marry the other person. So doing a letter isn't so far fetched at the end of the day. They don't ask for plans or anything like that, they want a statement. There's a reason for that. Because you've already given one, they want an updated one.

Our lawyer has cited the I-129F instructions many times. She is fully aware of the directions. As noted, you must submit an intent to marry which may include a statement of intent. However, she was going the route of proving our intent through wedding venue, ring, and videography receipts as well as informal wedding invitations and a written affidavit from my sister, as she is the wedding planner.

Yes, the instructions say it may be a statement of your intent. You can try and provide other evidence of your intent, but please do not be surprised if you get an RFE asking for statements of your intent to marry. You can do a search and see just how many RFEs are sent out due to lack of the 'letters of intent'.

Is a foto 5x5 ok for the i-129f? (iam the foreign fiance)

also is it ok if the head from the bottom of the chin to the top of the head is a little bit more than 35 mm (about 37 mm) ?

Seriously, you are stating that our answers are judgmental because we point out the fact that you are paying a lawyer to help you file, yet you are here asking easily answered questions and want to be spoon-fed all the answers. This is a DIY site. Most here do just that, and do it themselves without a lawyer. When going the route of DIY, it takes research, reading instructions, finding answers on your own and then asking questions when you truly get stuck on something.

If you are paying someone else, then they should be the one researching everything and spoon-feeding you all the correct information on exactly what you need to supply in order to be approved without an RFE.

When going the route of DIY, it takes research, reading instructions, finding answers on your own and then asking questions when you truly get stuck on something.
