Wife denied job even with EAD

Timeline

I do not think they had a right to use that excuse for not hiring her, if she was qualified.

I would file a complaint, with the web site's posters have listed above.

Some places require a minimum status of Conditional Resident (Green Card).

The law is quite clear, and has been mentioned more than once in this thread.

As someone else stated, you would be surprised at the jobs that one has to be a USC and get a clearance for. It depends on what data you have access to. The more obvious is jobs related to federal and military goods. But there are like clearances in the commercial area. Accountants often have access to a lot of personal information and are frequently one of the commercial clearance areas in public companies. Forcing a company to hire you is not going to make you popular and it will affect your rankings and ratings unless you are some outstanding person in what you do.

This will not be over quickly. You will not enjoy this.

Tell me how that (the law) is working out for you? Are you going to move on and find a job or complain about it? Successful people move on!

Successful people ensure that the companies they choose to work for follow the law. Requiring people to have a green card, as you erroneously stated, is no more legal than hiring only men, or not hiring Brazilians. The law applies to everyone. A county clerk in Kentucky is currently learning this lesson the hard way.

And I think you may be confused; I am very much employed.

The person from the UK, you don't face the same obstacles as someone from the Philippines or other third world country faces. Just because you were able to obtain employment without your green card in hand does not mean that it happens all the time. Employers are much more receptive to people who's English is their native language and they have minimal accent to where they can be easily understood. It doesn't hurt to be European decent as well.

I know that when my wife, which is now a US Citizen, first obtained employment in the USA, she was required to present her green card. Employers where she was seeking employment were not interested in anything less at that time. I am sure that other employers will require less. My wife also has a bachelors degree in elementary education and was a school teacher in her country.

Employers can hire anyone they want. They could simple state that you are not a good fit. They surely will not hire you if you complain about anything during an interview. All I can say is you can remain naive as long as you want. I live in the real world. Last time I checked, the gal in Kentucky still has her elected job, not that I agree with her position because I don't.

By the way, before I met my wife, I dated several Brazilian gals. Only one was legally here. The rest illegal. Poor example referring to Brazilians when it pertains to this conversation. That was back in Massachusetts where the state Government has an open door policy for illegals to come there.

I do not fault someone trying to seek a better life here in the USA illegally but what could be a better example. Its against the law to come into this country or stay in this country illegally. How's that stopping the illegals? Its not slowing the illegals coming into this country down.

What difference do you think you are going to make on this issue?

I picked Brazilians out of the air; I could just have easily have said Welsh people, Indians, Portuguese, etc. The point is that discrimination based on national origin is not lawful. The DoJ can and has taken action against companies where evidence exists of such discrimination.

You may also wish to check the following thread: http://www.visajourney.com/forums/topic/551366-discrimination-ead-card/ As you can see, a company was trying to pull the same nonsense of requiring a green card before someone could begin employment. This is illegal. A couple of calls to the regulatory federal agency and she was then offered the job (probably because it's cheaper than defending a lawsuit that you would lose).
