Not sure if this is the right place but i was wondering if anyone else has heard or a similar situation or have gone through something like this. So here is my story. Me and my Husband moved to Monterrey Mexico in 2012 we were married In Dallas Texas. We applied for my visa in 2013 we got approved in 2013 December. Then my husband decided to go back to the states to get everything in order for us to settle back up in Dallas. In March of 2014 i found out my husband of 7 years was with another woman at this point I have all 3 of our children with me living in Mexico. He completely stopped the entire process he stop sending paper work in or if he did send it something was always wrong and had to be sent again this delaying even further everything. All that was left for us to send in was my civil documents and the affidavit of support after that i believe came the interview. that never happen. Now my case is still says its at NVC but he will not continue the process. Now In july of last year i sent two of our children to him because he promised he was going to continue with the application and i will be reunited with my children back in Dallas. I belived him and now im stuck here in Mexico with one of my children and he is keeping me from the other two. I do not know where they live exactly and i havent seen them for over a year. MY question is can i continue the process on my own?? can i apply for a different visa?? I do not want to risk going back illegally and be taken to jail but im desperate!!!! I recently found out he was taken to jail for domestic violence and Im worried about my other two children can anyone help or advice me I do not have the means for a lawyer Im barely making it with my child here since i have no support from her father.

You have to go consult a lawyer. Maybe they will do pro bono work for you. Try contacting a lawyer here in US maybe contacting the Catholic charities to see what they can do. You being out of US I don;t know. But you have American Citizen Children. I am really sorry. This is sad. All the best to you.

One thing also you can't petition yourself. You can try getting a visitor Visa to go visit. But with you not knowing where they are don;t know. Are you sure the woman he has been with isn't the first wife? Seek a lawyer if for nothing else a free consult to see what you can do maybe.

maybe call some jails in area to see if hes still in there , and write to addresses you know and see if it gets forward to someone , who might have your children .. and get strong prayers .. i know that nvc doesnt want a year of not being contacted and now with him a record .. but see if you can have another person help sign with papers you money parts co sponsor but ,, need family sponsor ship on the first .. but ,, you need to find your children is a big hurt .. try all anvues but call nvc some how to see where your papers are .... what is going on for sure .. im just thinking of some things i would try .. my heart to you with prayers i dont know much on .. your story just needs to be acknowleged .. im just thinking of some things...

Calling NVC will not get her anywhere. He is still the Sponsor he wuld still have to fill ot a I-864 as well as any other joint sponsor. Since he isn't going to participate she has no avenue in that respect.

Hi,

Sorry about your situation.

Unfortunately, there is no way for you to continue the process on your own without your husband. There is no other visa that you can apply for.

To get your children back, you will need to hire a US lawyer or contact the Mexican government for help. Since you allow them to immigrate and be in 100% custody of the father and knowing that you had no legal means to come to the US, you are going to have a difficult time getting them back.

Sorry for the blunt assessment.
