That is the wrong forum. The OP is talking about an IMBRA I-129F petition waiver, not a visa ineligibility waiver.

To the OP, my advice:

1) Read the I-129F form itself and the section about IMBRA

2) Search the IMBRA forum here on VJ and do your research

3) Explain to your fiance and to the lawyer that 100% truth is an absolute requirement when dealing with immigration. If you lie, you will get caught and you will never get your visa.

She is asking all the questions because the Petitioner "knows everything". He has multiple filings and failures in a short period of time. And he thinks that more deception is the way to go. THis is not a game and he must be true to the details to find out whats right and wrong and together they can continue, if shes the only one doing the checking makes it sound as if he doest have much real interest or she is leading him into this, telling him how its done (only my opinion)

He has 2 prior petitions. one was approved. wondering how much he needs to know from her? My guess is he knows it won't go anywhere. Hence: Run Girl Run from all of us.

That would be the International Marriage Brokers Act which was enacted last year.

"IMBRA imposes limitations on the number of petitions a petitioner for a K nonimmigrant visa for an alien fiancé(e) (K-1) may file or have approved without seeking a waiver of the application of those limitations. If the petitioner has filed two or more K-1 visa petitions at any time in the past, or previously had a K-1 visa petition approved within two years prior to the filing of the current petition, the petitioner must request a waiver...."

Is the waiver part of the K1 packet you ask for at time of new filing or something you can do in advance?
