ok - it sounds like Mom can't prove up her USA domicile,

which is covered in the I-864 instructions.

you say it was denied but held open -

was a 221g document given over with instructions?

ask Mom to get into a copy shop, scan all the docs given over by the Vice-Consul on interview day, have the copy shop email them to you, and study those, a lot.

Yes, the only thing they gave my sister was a sheet titled "U.S. Residency" (in Farsi, not in English) and in it they have stated how residency works and one can prove that he/she is a US resident.

she should have gotten something else, unless that IV Unit is being a bit loose on her case, specifically ..

But she seemingly abandoned her residency 3 years ago.

Your mom for sure will be referred to attend an Immigration Court hearing in order to prove her U.S. residency and green card.Get. Please hire a great attorney specialized in Court proceedings, and prepare to pay a lot of money to hire a good attorney (5K to 10 K). By the way, a roundtrip ticket will ruin even more her case.Tell her to bring the IRS transcripts with her to show to the CBP officer.

Technically your mom has abandoned her GC & can petition no one

however I suspect , they denied your sister due to that but did not close out

your sisters case because there may have been extenuating reasons ...this must

be proven & verified , examplee mom was stuck there in ill health & traveling

was not recommended , but for 3 yrs it must be good, Upon arrival here due to

her age & a lenient CBP may allow her in to see an IJ...in the meantime sis is on

pause with them

Seems she was ill in the US and that is why she went home.

Begs the question if she is well enough to return. Especially as she seems to be older with no support structure.

Yes I think they were lenient toward my sister and the case is still open. I think my mother will take a chance and come back ( of course on a one way ticket) and live here. Once my sister is able to obtain a visa, she can take care of my mom.
