NVC screwd our case up

Hello everyone!

I am new here and I am from Germany and married to my husband Brian from New York for 3 years. We have a great relationship and wanted to live together, so when he changed jobs and made enough money, we could finally file for the IR Visas. I also have a little son from a previous marriage, but my Ex and I are still very good friends and he supports me in my decision to live with my husband in the US.

We filed the I-130 and without any problems it was approved and it went rather fast. They were really friendly at the USCIS and did everything smoothly and fast. But then, the National Visa Center took over and they royally screwed up our case. My paper work got processed very fast, but my son`s they really ruined. I don´t know if they can`t read or what, but they listed my son as my husbands brother, although it was stated clearly in the paperwork that he is my son. And they wrote a letter that there are no visas available for siblings of US-Citizens right now.

We called them and told them that he needs to be filed as my son, like it is written in the paperwork the USCIS sent to them. They checked on it and apoligized and admitted it was their fault and they did a mistake. Well, it is almost a year ago and until now they haven`t corrected that mistake although we called several times and asked for it to be corrected as we can not move on otherwhise. They said it can take years to correct a mistake like that. I thought they were kidding me. I have never heard anything like that before. They made a mistake and now we have to wait years to process with everything. I am about to giving up and do not wanna immigarte anymore. This is so ridiculous.....

Has anybody else had problems with the NVC? Or that their case got screwd up...I am really, really discouraged.

Sorry to hear about your problems with NVC. It's crazy that their mistake is causing such long delays for you. :( Have you tried contacting your senator? I have read many others here on VJ who were helped by their senator.

If it helps, know that you're not alone. Many of us have had issues with NVC or are dealing with delays because of them. In our case, they "forgot" to review my DS-260 (the visa application) and two months after I submitted it, we got a checklist saying I never submitted it. Before we sent in our AOS form, we also spoke to two different agents about what to write on question 13, since my husband is not required to file taxes, and wrote exactly how both of them told us to do it.... And got a checklist for it. When calling in to ask a third NVC agent what they actually need since my husband wasn't required to file taxes, we were told again that we had filled it correctly and she didn't understand why we got a checklist for it. These two wrong checklists are now at supervisor review, delaying our visa application with at least 52 days... Just praying it won't be longer. I can't even begin to imagine how difficult this is for you. :( I would call your senator and even considering going to the media with your case. I'm sure that would be something interesting to write about, especially since immigration reform is high on the agenda right now.

April 17th 2015 - IV fee paid


May 1st 2015 - Sent in IV application


May 12th 2015 - Sent in AOS and IV documents


May 18th 2015 - Scan Date


June 18th 2015 - Checklist received


June 22nd 2015 - Checklist response sent to NVC


June 25th 2015 - Put for Supervisor Review


Sept 15th 2015 - Request help from Texas US Senator Cornyn and his team


Sept 23rd 2015 - Our case is moved from supervisor review to NVC's team for dealing with Senator requests


Nov 4th 2015 - CASE COMPLETE!!!! :dancing:



Embassy Stage


Dec 16th 2015 - Medical exam


Dec 21st 2015 - Interview


Dec 21st 2015 - 221(g) issued at interview for updated forms


Jan 13th 2016 - Mailed our reply to the 221(g) to the US Embassy, received and CEAC updated the next morning


Jan 20th 2016 - Embassy require more in-depth info on asset for i-864


Feb 1st 2016 - Sent more in-depth info on assets as requested. Received the next morning


Feb 16th 2016 - Visa has been issued :dancing: :dancing: :dancing: :dancing: :dancing:



In the US


April 5th 2016 - POE Newark. No questions asked.


April 14th 2016 - SSN received


May 10th 2016 - First day at my new job :dancing:


May 27th 2016 - Green Card received


June 7th 2016 - Got my Texas driver's license

Your husband needs ro be contacting his congressman and/or senator about this yesterday. This should not take years to fix. It should already have been done. He also needs to speak to a supervisor (do not wait on a call back, keep calling until you can speak to one. This will take effort.)

1) keep calling the NVC till you get the supervisor if not

2) talk with you senator if n

3) take your case to the media

4) take those bunch of lazy , stupid people to the court

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
