Question about concurrent filing

Sorry if the answer is searchable...the search feature isn't working at the moment.

So, once my fiancee gets over here from Spain with her K1 (hopefully by the end of this year), we will get married and apply for AoS. My question deals with concurrent filing.

I am aware that you can file I-130 and I-485 together (the first being a prerequisite for the latter?). My question is:

Once we file both concurrently after getting married here, will the electronic I-94 serve as her documentation to stay here during this time? Or do we need to wait a certain amount of time after filing the two forms for her to get something showing she is legally here?

If she comes on the K-1 you don't need the I-130. You will file the I-485 along with the marriage CERTIFICATE (with seal or stamp) and the other forms. The I-130 is for people who are already married and want an immigrant visa. All of this is assuming you marry within 90 days of her arrival.

where you'll see the I-130 isna required ..

No I-130 for a K-1 adjustment applicant.

The fees for the I-765(EAD-work authorization) and I-131(AP-advance parole for travel) are waived when filed with a pending I-485, so include both of those too. It takes about 60-90 days to receive the EAD/AP combo card, which will allow you to work(along with an SSN) and re-enter the US when traveling abroad while waiting for the green card approval.

You need all the supporting documents for each form as well, so read the instructions for each one. You can also search here on VJ for what to include with each form if you get stumped. There are also example forms here on VJ you can look at when filling out the forms. They can be helpful.

Thanks for the replies. Darnell, I am on a PC. In my original post, I said the search bar isn't working. 404 error. Must be something with the forums, I tried it on both Chrome and Firefox.

Also, that's good to hear that I don't have to file a I-130...I don't know why I got it in my head that I had to file one. Good to know though, saves us money!

After you get married, you need to file for AOS (green card), EAD (work permit), and AP (travel permit) concurrently.
