I sent in my application last week and filling under 3 yrs rule-using a lawyer.

Is it harder when you file under the 3 yrs rule?

The lawyer didn't include any proof, just the 21 pages application.


Proof we have:

--File jointly IRS taxes (2014, 2013, 2012)

--join Electrical bills (Con Edison)

--Join Credit cards (about 3 of them , Freedom Chase, JC Penny, Sears, Visa) but the bills have on my name. Wife is autorized has her card with same numbers as mime)

--Join Bank stmt but it is really recent. We were using just credit card.

--State Id for both with same address

--Join Cable and Internet bill

--She is listed as beneficiary on my Retirement

--Join Insurance dental card

--House lease only has my name . too late to chnage until renewal.

--Have travelled 3 times for no more than 2 months on each (2 months on first 2 and 1 month on last ).

Is your spouse a natural born USC or also a naturalized USC? The two require different "proof" documents.

I filed under the 3-year rule (because the date I became a permanent resident is on 06/10/2010 and it's not quite 5-years yet). All I sent out was:

1) 2 pcs. passport photo

2) check for the filing fee

3) 21-page SIGNED application

4) IRS transcripts for the past 3 years (that we filed jointly)

5) copy of my [uS-born] USC husband's passport and birth certificate (they said one or the other, but I just sent both)

6) copy of both sides of my green card

7) copy of marriage certificate

This was based on the "Document Checklist" in the USCIS website. Anything else such as my old passport, actual green card, etc I will bring on the interview. Check the USCIS website for N-400 for the checklist.

Most of what you've mentioned are mostly requirements for application of the 10-year green card due to marriage to a USC. The permanent resident card due to marriage to a USC requires proof that the marriage was in "good faith", hence you need proof that you are living life together, have joint assets, etc.

I don't think the application for US citizenship requires you to prove the validity of your marriage per se. The requirements they are asking for would be to prove that you are married to a person who meets all the qualifications as a US citizen for you to be a valid applicant under that person. So if your spouse is a US-born USC, you only need to provide copies that your spouse is a valid USC by providing a copy of a US passport or birth certificate, and also proof of your marriage. If your spouse became a USC via naturalization you will require a slightly different set of docs to send with the application (like a naturalization "certificate" or something? I can't recall).

Other than that, I don't recall them ever asking for joint assets stuff. Just the major stuff that makes sure you are of "good standing" to be a US citizen (e.g. filing taxes on time, cleared of any criminal offenses, not part of a terrorist org, etc.)

Based on my experience, filing N-400 was a lot less crazy than filing for the 10-year GC. I didn't need to send out photos together, plane tickets for travels together, etc. I actually put everything together in a couple of days, I just put in a few more days to double- triple-check everything.

You ARE required to demonstrate that you are in a valid and legitimate marriage and that you are living with your spouse in order to apply under the 3 year rule. You don't need to send all that stuff with the application, but you should take it to the interview. Some interviewers are lenient and won't ask to see any of it all, but others will want to see everything before they make a decision.

I agree with JimmyHou in addition to what I mentioned -- I'd take everything to the interview just in case, but for the application I only sent whatever they requested in the checklist. Maybe your lawyer has already done this a lot so he knows just sending the application is just fine -- I sent mine based on what I read on the instructions in the USCIS website. And from what I gather from what they're asking, it's more to prove that you are [and STILL] married to a USC, and that USC is qualified to "sponsor" you in becoming a USC.

My wife is a US born. We got the conditional removed last September and was concerned that maybe it is too early to do this again.

I mailed the package today. Will I receive a confirmation that they received by email or phone?

If you submitted form G-1145 with your N-400 packet, you will get a notification by text or email containing your case number when they have received it. If you haven't you will have to wait for the NOA letter, which will contain your case number.

Either way, G-1145 is just for the initial update. For subsequent alerts on updates of your application you will have to set up an account with the USCIS website with your case number at hand (aside from the appointment letters they'll send you eventually).

Int Ltr: Date you received the official letter in the mail regarding interview
Intview: Date of your interview
Oath: Date Oath taken
Field Office: Your local USCIS office where you would be doing the N-400 interview
