Our fiance visa was approved March 17th , how long does it take to receive my packet to travel ? ?

Is it possible to apply for a work visa when I am at the customs and immigration border ?

Why do you have to apply a work visa while you are already have a K-1 visa? You can apply EAD while file I-485.

Agreed. If you are coming here on a K1, you will need to go through the AOS process including the EAD/AP after marriage to get authorization to work and travel (internationally).

You need to apply for the EAD after you're married. There's no getting it before that.

November 14th, 2013: She's here!

December 12th, 2013: Picked up marriage license.

December 14th, 2013: Wedding

I believe you can't apply for a work visa while you have a K-1 visa on your passport. I never heard you can apply a work visa when you are at PoE.

You have to have a reason for EAD - employer already hired you, spousal, K-1. You can technically apply for the EAD after you arrive in the states, however it's pretty pointless in many cases. Unless you're planning on waiting a while (almost the 90 days) to get married, the EAD takes typically 90 days to process. If you do it in this manner you have to pay the EAD fee. You will also have to pay the AOS fee. If you file them together after you are married it waives the EAD fee.

Since the K-1 expires within 90 days and it takes 90 days to process the EAD anyways.. it's up to you, if financials are not a problem then do it this way if you're insistent on working ASAP. Otherwise it's more financially sound to marry ASAP and file your AOS+EAD.

Either way though, unless something has changed, this can't be done at the border. You have to file the form with USCIS and wait for your card to arrive before you are on the official EAD card.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I am really not in any hurry to work, I was just curious. As to why it took so long for my interview/approval ?? I really don't know, we didn't have to summit any extra evidence, nor there were no mistakes in paperwork . I guess it's was submitted at a busy time. We did request an inquiry as to why it was taking so long . But was just told it was in process and to be patient. We were 380+ plus days patient. I'm more relaxed now that I know we can make our plans and our days of jet setting 3600 miles is soon done . Good Luck to all that's still in process
