So, I brought my wife here on a K-1 visa on 21NOV2012. We were married on 05DEC2012 and have already had our initial interview. From what I have read we need to wait for the 90 day period to start the AOS, but I have also read that if you have been married less than 2 years you need to file for a removal of status of some type within that same 90 day period.

Her visa is set to expire some time in June, and I do not know what we should be doing right now. Do i need to submit the AOS? Do I also submit the Removal of Conditional Status form? Should I take her to the local embassy to get the visa renewed? Any and all help would be greatly appreciated.

Respectfully,

Sean

I would start by reading the guides, there are many wrong assumptions it would be pointless addressing them individually.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

I have the read the guides, which is more or less why I am posting. I am confused.

Also, an edit to the top. I have already completed the AOS, I guess I am on the part of Removal of Conditions.

I got it. I was just confused on timeframe. I was unaware that we had already done the AOS (for some reason I thought AOS was filed with the ROC). The confusion was that I had already done the AOS and so when I was reading the guide on that stuff it sounded like paperwork I had already done.

So, in fact, I have already completed the AOS and just need to file the ROC. I am still a bit confused on what to do with the visa/passport.

I am still a bit confused on what to do with the visa/passport.

A K1 visa is a single entry visa, once it's used, it's no longer relevant.

Her visa is set to expire some time in June, and I do not know what we should be doing right now. Do i need to submit the AOS? Do I also submit the Removal of Conditional Status form? Should I take her to the local embassy to get the visa renewed? Any and all help would be greatly appreciated.

What visa? As I just stated, once the K1 is used, it becomes irrelevant. Furthermore, it's probably her Green Card that is expiring in June, not any kind of visa.

Yes. Also, once the I-751 is filed, status is automatically extended past the Green Card's expiration date.

You seem to be over thinking this and making it all very complicated.

Your wife came over on a k1 visa which expired the moment she entered the states as it is a one time entry visa.

She then applied to adjust her status and recieved her two year green card.

She now need to file for removal of conditions to get her ten year green card.

Just follow the guides for roc. No complications needed.

You are definitely over thinking this brother. My wife got here in Oct 2012 and I filed the AOS in January 2013. We got her Green card in April of that year, and it expires in April of this year. I filed her ROC (I-751) just a few weeks ago, we have already recieved the documentation showing that it is extended for one year or until we get her new green card.

The K1 visa was valid only for her first entry into the USA. The Green card is the only thing that makes her legal here in this country. So work on the I-751 and submit it before her Green card is expired.
