I just received an RFE for a bunch of paperwork. Some of it has to be brought from Russia. Hopefully I will be able to mail it to USCIS by the end of April (they gave me time until end of May).

So I do not expect the petition to be approved until June or so, even if they are satisfied with my RFE response.

PD: Feb 27 2014

I130 approved july 23, 2014

but NVC hasn't received my case yet. I think my case was sent to National records center (NRC) instead. People in this forum have told me that I have to wait until the PD becomes current and then to contact NVC to transfer my case from NRC to NVC. But would that be too late. I say that because in NVC website, this is what it says - "As your Priority Date gets closer to the Cut-off Date and is likely to be current soon, NVC will contact you to start processing". Which means that NVC should have my case before the my PD is current right? I'm confused guys. Help me out please.

PD 8-21-14

jan11(noa2)

jan.28 (case received by NVC)

no further updates

PD : 18FEB2014

CSC Service Centre

Case at NVC from April 2014.

No further updates after that.

PD : july 24 2014

NOA 2 : january 6 2015

Case waiting in NVC

Let me ask you guys. Since you guys have PD that means you guys are married to LPR right? Someone married to USC doesn't have to wait for PD to be current, isn't it? So my next question is my case was sent to National record center (NRC) because my PD was not current and they say that it is normal for the case to go to NRC instead of NVC for someone who is married to LPR if their PD is not current. How come your case was sent to NVC then? I am a newbie please help me out guys.

Hi Subee9,

Apologies for replying late to ur post. Just seen your post hence replying now.

Let me answer you questions 1 by 1:

Since you guys have PD that means you guys are married to LPR right?

YES

Someone married to USC doesn't have to wait for PD to be current, isn't it?

YES

This is something new to me, infact am not sure what does actually NRC does and what they have to w.r.t to immigration process. May be somebody else out here can answer this question better.

BTW what is your Priority Date?

Entirely new to me as well, I am a Sept 24th 2013 flier, my case was approved by CSC in Dec 2013, got a letter from NVC In FEB 2014, confirming receipt of my petition and my priority date not being current, the e-mail says NVC

would contact me when the case is close to being current which was exactly what they did, you can look my timeline. Did you receive an e-mail from NVC? What is your priority date? When you track your petition on USCIS website the last stage is sent to NVC.

Hi,

Have patience. Currently the VB has the date of 01AUG2013 so roughly i say the waiting period for you could be between 10- 12 months (if the current advancement of the dates continuous like this). until you finish all your process.

At-least your i-130 has been approved in 4 months, we have friends here who have been waiting for more than a year now.

So as i said earlier, have patience and do not get frustrated...!!!!! You are not alone in this journey.....!!!!!

Hi, guys. I just received an e-mail from USCIS. My case was transferred. Hopefully, good news will follow soon! Here's a bit of the e-mail:

*** DO NOT RESPOND TO THIS E-MAIL ***

There has been a recent processing action taken on your case.

Receipt Number: EAC**********

Application Type: I130, IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN

Your Case Status: Initial Review

On March 24, 2015, we transferred your Form I130, IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN, Receipt Number EAC1490229588, to another office for processing and sent you a transfer notice. The notice explains why we transferred your case. Please follow the instructions in the notice. If you do not receive your notice by April 23, 2015, please go to

www.uscis.gov/e-request to request a copy of the notice. If you move, go to

www.uscis.gov/addresschange to give us your new mailing address.

During this step, USCIS initiates the background checks of the applicant/petitioner and identifies issues that may need to be addressed either during an interview or by asking the applicant/petitioner to submit additional information or documentation. USCIS reviews the applicant's/petitioner's criminal history, determines if there are national security concerns that need to be addressed, and reviews the application/petition for fraud indicators.

Blah, blah, blah...~~~

Thanks so much for your kind words. Can i ask what next will i be receiving after this confirmation of I130

After your I-130 is approved by USCIS, it will be transferred to NVC. NVC will send you an email notifying that they received your case and your PD is not current and visa is not available at this time. They will send you another email when your PD is about to be current within next six months or so asking you to pay AOS/IV fees and submit all the supporting document. You have to be patient as it might take months (8-10 months) between these two emails. After you finish paying the fees and submit the documents, NVC will take 60 days to review them and send them to your USA embassy and if your PD becomes current, they will schedule your interview. Then you need to do medical exam and attend the interview. Thats the short summary. You should read up on full details of this process.
