Hello every one it's my first time posting here so please bear with me :D

So my fiance and I are same sex couple and planning to file for K-1 visa!

I'm preparing the I-129F, my fiance is single never married but have a 6 y/o daughter,

and we're planning not to bring her daughter yet.

Not until we settled everything and my fiance have her GC and have a work already.

so we can provide a better life and hassle free life for the child as much as we can.

we don't want her to be

caught up on all the stress of filling a buttload of paper work and fees need to be paid.

so should we include her daughter's name on the I-129F?

or is it required to put her daughter's name on the I-129F?

any advice how will we handle this?

Children can wait up to a year after the main beneficiary enters. I'd advise including the daughter's name, she can always come later if that's what you want. Bear in mind that if you fiance goes to get her daughter, she will need either advanced parole or have adjusted status already.

Yes you need to list the child on the I-129F

I have a similar case as you. We are also same sex couples. I included my fiance's daughter in the petition. I advised you to do the same. K2 beneficiaries have up to 1 year to come to the US. If the child is not included in the K1 petition then u guys would have to file a seperate petition for her and also adjust her status separately which will cost more. So, just add her to the petition.

thank you everyone for the replies really appreciate it but I have one more question

my fiance don't have custody of the her daughter the child lives with her grandparents

( dad side's) and we think that the dad won't agree to bring the child in the U.S.

he may not sign a consent paper.

do we need the dad's consent to be able to put the child on the form I-129f?

or can we just not put her in the I-129F and just petition her later on can we do that?

thank you guys for your time we really don't know what to do

You list all children as it asks on the I-129F petition.

Consent for the child to move to the US would not be needed unless the child applied for a visa later.

The custody will be a challenge. I did need to show my divorce decree that show I had sole custody of my children. I also had a letter from my ex-husband stating that he knew we were moving to the U.S. This was not permission so to speak but it was acknowledgement. Again, I had sole custody and those documents were included in my package.
