Hi everybody :)

My question is this, I am a Canadian citizen and my American boyfriend and I are planning on starting the K1 visa process this summer. I haven't worked for some time due to personal issues and I'm just wondering if my current employment status will be a factor at the time of the interview? In basic terms will the fact that I am unemployed at the time of the interview effect anything as far as us being able to get the k1 visa?

Hi,

The K1 process takes a little while so there is a chance that your employment situation will change. I saw a couple of posts where the beneficiary was unemployed at the time of interview and was granted a visa with no issue. Your fiance will need to meet the income requirements and prove that he's salary is above 125% poverty level.

If you have enough money to support yourself i think it'll be okay. most likely your bank statements and tax return will be enough to prove.

May I ask why you plan on waiting until the summer? I regret not sending my application a few months earlier! Depending on service center, there is a chance that filing in summer may mean having to deal with the end of year holidays etc.

No it does not matter if you are working are not.your american boyfriend is the petitioner and will have to show that he makes enough for you and him

The foreign fiance(e)'s employment/salary has no bearing on the visa. It is the USC petitioner that needs to fill out an affidavit of support and prove they meet the income requirement.

firecat: We are not planning on getting married like right away but we are planning to start the process some time this year so I'm just trying to figure out how everything works etc. and if there will be any complications or anything like that and I honestly couldn't be more thankful to all you for being so helpful.

Please keep in mind that Obamas Immigration reform will come into effect most likely in a couple of months or so. Right now the waiting time at TSC is 6 months. This may delay their work for another while.

yes the same thing apply regardless if the petitioner is a guy or girl. The American petitioner must show that he or she makes enough income to support their self, their fiancé and any other dependent in the household

What is the immigration reform? Does that mean I wont be able to immigrate or do you mean it will take longer and if so how long will it take if we wait until say June or July to start the process?

Hi JessicaAmber,

Around 5 million undocumented immigrants will get a temporary (2year) deportation relief and authorization to work. This can cause administrative backlog. You will be able to travel of course but if you start your process in June or July you may end up waiting for months and months. I spoke to my friend who is an immigration lawyer in Atlanta but she can't give me any answer yet how this will affect K1 and other petitions.
