AOS Cheque - Did we do it right?

Hi everyone,

My husband and I filed our K1 related AOS forms a few days ago and checking the mail tracking number, I can see that it was received on November 18th. When he wrote out the cheque, he wrote it out to "USCIS" for the filing fee and the biometrics in one. Did we file this correctly? I become such a ball of anxiety every time we file something, scared we messed up.

Also, in the event that it is incorrect, what happens then? Do they send us our money back? Do we send a new check? Resend all the paperwork?

Thanks in advance.

It's correct to combine the fees into one check, but it should have been made out to "U.S. Department of Homeland Security." (The I-485 instructions do explicitly spell this out).

I'm not 100% sure if the package will be returned, but it probably will be. If it is, they'll send you your whole package back and all you need to do is write a new check and resend everything.

I'm the USC petitioner.

Review page 5 of the Form I-485 instructions: http://www.uscis.gov/sites/default/files/files/form/i-485instr.pdf

and USCIS link: http://www.uscis.gov/forms/paying-immigration-fees

Your entire package will likely be rejected and sent back to you for correction and resubmission.

Good luck on your immigration journey.

Even though the check was made out wrong, I am glad they went ahead and accepted it. Glad they were not so strict about who the check was made out to and spared you a rejection.

There is no excuse for us not following the instruction accurately,

but on the other hand, c'mon...it's probably all funny money between the

USCIS and U.S. Department of Homeland Security anyway.

Since they cashed it, hopefully it will proceed as usual.
