RFE question...help!

Hi everyone,

Wasn't sure where exactly to post this so I just started a new topic.

We filed our i-129F in June and got notice of an RFE last week. It just came in the mail and seems pretty self-explanatory because I'm an idiot and overlooked 2 questions. HOWEVER, the officer highlighted where I (the USC petitioner) signed and dated the end of the application (under part 4: signature of the petitioner). I have no idea why that was highlighted. It's my signature and the date. Does that mean I need to re-print that last page/sign and date it? Has this happened to anyone else before?

Really appreciate any insight on this. Thank you so much!!

I don't have any answers to your questions but for the sake of information do you mind telling us what questions you overlooked? By the way, an RFE at your stage is a good sign. You will probably be approved within a month after having sent it. Maybe sooner. good luck.

Maybe you need to resign since you are adding information? I would submit an entire new form with answered questions and new signature....just my opinion!

Thanks, I was thinking that I would just submit a whole new form but the letter implicitly states to just fill in the categories on the photocopy they sent that are highlighted. But I think you're right about resigning since I'm adding new info. I'm just going to re-print that last page and resign/date so that they have my signature again.

But any other advice from anyone who's ever done this before would be super helpful! :)

Out of interest which were the questions you overlooked? This might benefit others in the future to look out for those ones in particular.

November 1st 2014: I-129f submitted for K1 visa

February 24th 2015: Visa in hand!

February 26th 2015: POE at Las Vegas airport, then onwards to Oregon! 

March 6th 2015: Marriage (with a "real" wedding to follow next year on 7/6/2016)

March 9th 2015: AOS, EAD & AP submitted

September 22nd 2015: Interview

January 14th 2016: Two year Green card received -phew!

ROC

August 8th 2017: 90 day window begins! ROC time!

September 28th 2017: Biometric Appointment in Portland, OR

March 5th 2018: Case received by local office

August 18th 2018: 18 month extension letter mailed

December 2018: Case moved to another office

February 2019: I was emailed that I was approved and my card was in production the same day of my N400 interview 😂

August 8th 2018: Window opens to submit naturalization application

I'd send an entire, signed I-129F AND send what they asked foe and write an explanation. These officers like it when they don't have to look for or figure out stuff. Good luck!!!

Thanks for the responses - I thought about sending a whole new packet but I called USCIS and they send to follow the directions in the letter - and when I asked if I should print out new stuff and fill in a whole new application, the customer service rep said that if the letter doesn't state a full new packet then don't do it. So for anyone moving forward - if the letter doesn't ask for it, don't do it!

As for the questions I missed? Under the section asking about previous marriages, since there were none to report, I missed the question concerning whether my fiance has ever been to the US (obv he has) and I missed the question(s) concerning any criminal convictions because I literally just overlooked it. I think when I originally filed, I was more concerned with getting all the letters, photos, passport stamps, plane tickets, etc. compiled and just missed the questions.

I agree with doing exactly what was asked for but I also would sign each additional comment/reply that you add... just to be on the safe side.

Mar 2011 - After 5mths denied for lost docs - Attempts to follow up failed. Mar 18 2012 - I-129F sent - No sign of NOA1 but they have banked the check...Jul 24 - Update - USCIS has located our file
Infopass Apt - they sorted through everything - our 2011 and 2012 file keep getting mixed up - getting us a Case# (still waiting) Dec- Infopass Appt- expecting to get a case # in about a week ..Still no Case number

Mar 2013 Infopass - advised file was in a box somewhere,and it would be quicker for us to refile. Life gets in the way... New petition submitted July 2014 .

This is a sneaky one, my OH only just caught it right before we were about to package everything up! So I can totally sympathise, that one is not very clear. Also, it seems a lot of people miss the criminal convictions section, again they need to make this more obvious!

Hi :) we have the same experience..My fiance missed the criminal conviction part too..but we already sent back the RFE reply last Nov.11 and they received it Nov.13..until now, we're only getting RFE Evidence received notice in USCIS site...I'm getting nervous :(

ah, glad I'm not the only one! :) did the petitioner have to resign the last part too? I'm mailing ours back in about an hour, overnighting it with a signature - to make sure they get it ASAP.

I wouldn't get too nervous, if you look at Igor's list it usually takes them 2-4 weeks to look at the case after an RFE and decide on approval (but that waiting part is killer!)

5 days at a USCIS service center is equal to an hour in real time, so I wouldn't worry just yet. (sorry, bad joke, but really, you need not worry yet)

Hello! We also got RFE issued on Oct 15th due to my fiance criminal record part. Then my fiance submitted documents required back on Oct 31th. Ever since then, our USCIS case status is still shown as "Request for Additional Evidence Was Mailed". Should I excpect this status to be "RFE Evidence Received Notice" eventually? It's been almost 3 weeks since submitting the documents and I am getting nervous too! I hope they are working on our RFE. I'm worried. :/

Ours took almost 1 week.. but in ur case, almost 3 weeks, u should receive a RFE Evidence Received Notice.. I pray u get the received notice soon :)
