Hi. its me again.

So im speaking with my fiance about "yes I can visit" and he is telling me the last lawyer (the one who told us Im not going to help you, you better get the K1", SAID I CANT VISIT WHILE SHE IS APLYING for the K1

I dont get it...

That lawyer was very wrong and misinformed.

People visit through their k1 process constantly.

Absolutely.

Nowhere does it say that you can't visit. You just might be asked to show ties to your home country. They do have the power to deny your entry if they don't think you're convincing, but it seems that most people are successful in that.

If you're still in doubt, simply call USCIS :)

Also, it doesn't appear you are going with the Adjustment of Status route, but...Remember that if you come here, get married, and try to adjust your status, it's going to be very hard to prove that this was not your intention all along IF MANY FAMILY CAME WITH ALSO TO SEE THE WEDDING. During your Adjustment of Status paperwork, they will will want photos of your wedding (and those photos will show your family here for it).

Yet another option (what we did), is that you could come here and get married, and then go back to Chile and apply for a CR1 spousal visa. The wait may be the longest, but it's also the cheapest. Plus, it would allow you to have your wedding in Vegas with some family members attending as planned (so you won't need to change plane tickets). Finally, you can begin working immediately upon entry with CR1 visa, versus a K1 visa (you might have to wait months).

I'm very doubtful that your K1 visa will be approved by the time you come here in January. Plus, regardless of what the post says, if the border agent asks or knows that you have K1 application in their system, they may not let you enter the country. They can deny ANYONE entry if they believe for ANY reason that person has an intent to stay.

I'm very doubtful that your K1 visa will be approved by the time you come here in January. Plus, regardless of what the post says, if the border agent asks or knows that you have K1 application in their system, they may not let you enter the country. They can deny ANYONE entry if they believe for ANY reason that person has an intent to stay.

Which is why it's important to show ties to your country. I always travel with a letter from my employer a recent pay stub, and a copy of my lease for my apartment. Up to now they never asked for anything. However when I go through preclearance at the Montreal airport, I saw a difference between my first trips when I said I was going to visit my boyfriend and the last one when I said my Fiance because we had gotten engaged. The CO was very nice and actually funny, but he asked more questions, specifically asked if I was planning to get married and stamped my passport which they usually never did.

My suggestion is to show ties to home, maybe bring an upcoming contract you may have for work, and if you're renting a place, you could ask for a lease or contract as proof.

A couple things: lawyer 4 is correct; you cannot come here with the intent to marry and stay. That's visa fraud. You can, however, come here, get married, then go back to chile and file a spousal visa. You can also file the K1 NOW! There's no reason you can't come visit in January while it's still in process. You just can't stay that trip. You will also need to prove ties to chile so they don't turn you away at the airport, but no reason why the K1 process can't be started now. With him living in Vegas, the case will go to CSC, which means there's a good chance it won't take months and months to get to your embassy. I'm sure others will chime in too. Congrats on your recent engagement!

Yes I would agree with this scenario...BEST to be 100% honest....at the Point of Entry into Las Vegas just tell them that the K1 has been applied for, take documentation like the NOA1 to show it has, and also documentation that you have to go back to Chile after your visit here.

Ok, so I want to tell everybody its was a miss undertanding between my fiance and the lawyer. Yes, you can go for sure to visit, and I will take the most proofs I can that Im going to stay for 2 months only, and then come back to Chile and wait for the correct Visa.

Now we are ready to start with the K1.

Still we want to get a lawyer.

I know if we do the process by ourself it could cost us 2.000 (aprox)

I we get a lawyer we are thinking something close to 3.500- 4.000

Its is indeed a bunch of money but we believe with a lawyer everything will be easier. We are paying for peace of mind...

We apreciate all your help and Im gonna keep posting all the information I can!

Hello! I understand why you two want piece of mind for filing the visa. I personally feel that you do not need to have a lawyer. My husband is from Chile and we did all the paperwork on our own. If you have any questions I would be happy to help. Good luck!

Peace of Mind? Get peace of mind and do it yourself and know that it is done right the first time. after talking to all those attorneys you trust one? If you read the guides here you will know what needs to be done and you can do yourself and do it right for your self the first time. There are no papers that need to be notorized, no papers that need to be filed to a special court. just forms to fill out with your information and mailed to an address. An attorney does not have this special information. he gets it from you. he licks the stamp and charges you $$$$!!!! You can be proactive with your information. you can call NVC and get case number and IIN and start things moving. Attorney will wait till letter comes from NVC. save yourself a few weeks call NVC as soon as NOA2 comes. you dont need attorney unless you have complicated past i guess.

Thanks for your answer but we decide to hire and attourney. I get that we could save money, but I guess its every couple decision, and we are happy to say that we find somebody that we trust.

Anyway, we start this process next monday,

I know there is a lot of good people here, we aprecciate all the help that everybody here give us.

I will keep posting all our story, I hope it could help somebody as well.
