NVC and its trend of losing document.. scared ???

As i am heading to my country (nepal) in few days to get all the documents for NVC (like birth certificate, passport, PCC, death certificate of my parents) and i am already scared and nervous because of the way nepali government office works. And the law firms that i am trying to contact in Nepal are just so lousy of not responding back with info.

As you have seen, we had this query about ITIN and wedding certificate being acknowledge in US. Thank you guys for all the wonderful help and advise. You guys are awesome.

Our lawyer said (when we initially consulted for i-130), that we better have 4 certified copies of every documents (my birth certificate, PCC from India and Nepal). But as i am reading NVC wants original certificate of marriage to be sent. We are scared about that. I have read many folks in this forum posting about NVC missing the documents. What if they lose our original wedding certificate ??

Question is, will NVC accept the certified copy of original wedding certificate from my country??

one more question (this is important coz we have to save money for fees); do we need to hire lawyer for easy sailing through the NVC stage. We meet couple of people in Kathmandu Embassy (in May that's when i and my USC wife were in Nepal together), they all advised to have lawyer. What is you guys take on this question???

Get backup original copies of everything. Every. Single. Thing. We have three copies of our marriage certificate, multiple copies of birth certificates, etc, so we have backup copies if something is lost during any point of this process. We ordered the stamped and sealed copies from the registration office. The only thing we don't have multiple copies of is my police check.

Met in 2010 on a forum for a mutual interest. Became friends.
2011: Realized we needed to evaluate our status as friends when we realized we were talking about raising children together.

2011/2012: Decided we were a couple sometime in, but no possibility of being together due to being same sex couple.

June 26, 2013: DOMA overturned. American married couples ALL have the same federal rights at last! We can be a family!

June-September, 2013: Discussion about being together begins.

November 13, 2013: Meet in person to see if this could work. It's perfect. We plan to elope to Boston, MA.

March 13, 2014 Married!

May 9, 2014: Petition mailed to USCIS

May 12, 2014: NOA1.
October 27, 2014: NOA2. (5 months, 2 weeks, 1 day after NOA1)
October 31, 2014: USCIS ships file to NVC (five days after NOA2) Happy Halloween for us!

November 18, 2014: NVC receives our case (22 days after NOA2)

December 17, 2014: NVC generates case number (50 days after NOA2)

December 19, 2014: Receive AOS bill, DS-261. Submit DS-261 (52 days after NOA2)

December 20, 2014: Pay AOS Fee

January 7, 2015: Receive, pay IV Fee

January 10, 2015: Complete DS-260

January 11, 2015: Send AOS package and Civil Documents
March 23, 2015: Case Complete at NVC. (70 days from when they received docs to CC)

May 6, 2015: Interview at Montréal APPROVED!

May 11, 2015: Visa in hand! One year less one day from NOA1.

Certified copies are just as good as the originals. I don't send my original documents, I get certified copies which are essentially original.

Having a lawyer will not equal easy sailing through the NVC. In some instances, lawyers screw things up resulting in delays.

thanks for the advise. I have seen lawyers screwing people over here in forum.

I also saw lawyer had less info than we acquired by reading from VJ when my wife went to lawyer in US.

we have to see how we deal with lawyer thing. I mean if delhi embassy will allow my wife to come with me for interview we cant afford to hire lawyer coz that will cost extra back and forth flight ticket for her.

So once i return from nepal with all docx then we will try to visit or write delhi embassy for any info on this regards, then we will decide

thanks guys.. I was telling my wife that all the courage that i get after reading and seeing people here is amazing. And u guys make us feel like family. Thank u so very much

If the Embassy in New Delhi will not allow you into the interview area, they would not allow a lawyer in either.

I don't even have possession of original certificates. My parents never purchased my original long-form birth certificate and the county court kept our original marriage certificate (though I'm starting to wonder if they should have done that!). Certified copies are definitely ok even to bring to the interview, but not notarised copies.

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.
