I am feeling pretty furious right now. I just met my best friend who was telling me about her cousin who just got married to a guy in states who is there on h1B visa. And as far as I know her husband sponsored her. Yet she is so sure she is gonna be there in 5 months. I explained to my friend the whole procedure and asked her that does it make sense to u that I being a wife of born citizen is stuck here for 2 years and she will get her visa in 5 months. Unless she do some fraud and takes a shortcut. This immigration is just really unfair and does not make sense to me at all.

I know the feeling of this - I have a really great friend who did the 'work around' - meaning he went to the US and got married to a US citizen, stayed with her just for getting the Green Card and then divorce afterwards. Now, good friend meaning I can't 'technically' be mad but to think we are sitting here paying tons of money, waiting ages for the approvals, some of us getting stupid, inconsequential checklists and waiting even more...and then there are some that are working around the system and not feeling a pang of what we are.

It's injustice, but it happens in every aspect of every 'legal' laws - I was reading recently about how soldiers (okay not the vast majority) who are using this process as a money making scheme while they are overseas (because getting married and adjusting your status will get you more pay over seas and then they take a commission from the person who is marrying them as well.

...I realize in life I could be frustrated at these practices or just know that I am doing what I can to ensure my family doesn't go through any hardships and prevent the rare occurrence that they may get caught (which I say again...rare). I hope you remember that you are doing things that keep your family safe and sound and waiting these long times (even though some are cutting the line) will ensure happiness in the end. (L)

Makes me furious also, I don't even know what a h1B is but my next door neighbor's daughter married the guy came to visit her married and stayed he does not have to go back and wait and will have a visa of some type in a couple of months. Yes my husband can't ever come to visit me. I don't understand their reasoning at all. :(

They talk about immigration reform but they don't mean real reform they are only talking about illegals since they seem to have more rights than we do. :( I'm really tired of this!

I know the feeling of this - I have a really great friend who did the 'work around' - meaning he went to the US and got married to a US citizen, stayed with her just for getting the Green Card and then divorce afterwards. Those people are disgusting and I for one rather do it the right way. What total lack of morals to marry someone for a few gold coins.

Hi samreen,

yes its illogical. Since your friend was already on a work permit (h1B) in USA, when her spouse (a LPR) sponsored her, they can file both the I-130 and the I-485 (extra stuff) at the same time. Think of it as filing your I-130 and the NVC paperwork at the same time Including the interview at the consulate ( all in one). So once they get their I -130 approved which for most people is 5-6 mnths ( i know it can be longer in some cases) they can get all of their paperwork done in 5-6 months.

I now of my friend who went on a student visa and married a US citizen. But before their marriage his student visa expired. We started the process in november of 2013 .. i have waited more than a year and he got everything done by march of 2014..just because he was within the country and i am outside. I know its not fair and is illogical.

To bes honest until 2012 all cases even from the outside the USA were moving along faster less than 8 months. What has happened to you and soloenta is just beyond ridiculous in my mind.

I am feeling pretty furious right now. I just met my best friend who was telling me about her cousin who just got married to a guy in states who is there on h1B visa. Hi there, you're in the wrong section of the forum. This thread is for people who are trying to get a spouse visa from abroad, so we never go through the Adjustment of Status process (we get our Green Card as soon as we enter the country).

Did you come in on a K1 visa? You might find more help here: http://www.visajourney.com/forums/forum/131-adjustment-of-status-case-filing-and-progress-reports/

If you came in on a tourist visa or something else, go here instead: http://www.visajourney.com/forums/forum/138-adjustment-of-status-case-filing-and-progress-reports/

I'm sure you will find more help there since they will know the process of Adjusting Status.

I hope your situation is resolved ASAP.

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

Oh yes all will be fine. Don't worry at all about it. InshAllah :) I m nervous about the interview. Hopefully they will give me approval. I can't even think about the other possibility!

Insha Allah her medical should be fine and you will be getting approval on December 8th Insha Allah. For my wife interview there is one part where I get little nervous. I was in Pakistan for 2 weeks earlier this year for my wedding and only stayed there for 1 week after wedding. I couldn't visit her again because I get only 12 vacation days in a year. I am hearing that COs consistently ask all Pakistani immigrant applicants about their spouse stay and visit in Pakistan. I just hope CO doesn't make a big deal out of it. I am sending my wife the administrative directive stating my organization vacation policy so hopefully when they ask her she has it covered. I thought I130 and NVC was hectic but tension grew to the max when you can see the end. I will pray that everyone who has an interview get approved with flying colors Insha Allah :)

Yes. My noa1 to interview date took 550 days!! I mean it's pure pure torture what we went through and then people just come and tell me these stories I feel like snapping at them so badly. I can't be happy for anyone else. I don't know if it's selfish or not. I just can't be for people who go thru these shortcuts. What happened to us was agony beyond words and my poor sister is still going through it. I pray for her that she comes out of it soon. We don't deserve this.

Others are getting CC ahead of me (October is starting and I'm 29 Sep) and it makes me worry that it's because we have a checklist. My husband is living in Australia earning Australian dollars at the moment which was what we put for his income, I'm worried that won't be enough for him to be my first sponsor. At least he has been offered a job for next year in the USA so we can send that contract in if we get a checklist. If we do I will be heartbroken, it will mean he will have to leave Australia without me and we'll be apart for awhile :(

I am the beneficiary. My husband is the petitioning USC.

Relationship:

Met in Washington DC - 13 February 2013

6 visits (Guam and Australia) in 2013

Engaged on Guam - 31 December 2013

Start living together in Australia - 3 March 2014

<3 Married in Queensland <3 - 28 June 2014

Yesterday was our 30 day mark, I guess 30 more to go. :(

8 days to go !!!! It's taking forever it seems

I know it's not easy but try to look back and see how much you both have already gone through and how much longer this torture will last. Your so close my dear friend so very close. :Dt5063.gif

Praying you don't get a checklist, but try to think of it this way if it happens you wont have to be separated for long at all. But will be praying get you CC Monday. t5063.gif
