I've been over the guide a billion times and still going over it again but also want to get confirmation that I'm tracking.

Checklist:

  1. wait 2 weeks, apply for SSN (for both K1 AND K2?)
  2. Apply for marriage license together
  3. Set marriage appointment
  4. Get married
  5. File for AOS (K1 and K2) & EAD; and maybe AP
  6. ROC

Health Insurance:

What do I do? Looks like insurance from work won't cover them until I marry her and adopt him. I've never had to seek health insurance as I've worked pretty much all my life. Contact a provider directly or go through Health Connector/Obamacare? BTW that family coverage cost is a killer......man.

When my K1 and K2 came I bought an emergency policy for them until we got married. It was like 100 bucks for 45 days. Then my work insurance covered both of them when we got married. I didn't have to adopt my step son.

I've been over the guide a billion times and still going over it again but also want to get confirmation that I'm tracking.

Checklist:

  1. wait 2 weeks, apply for SSN (for both K1 AND K2?) As others have said, K2 needs EAD or GC to obtain SSN.
  2. Apply for marriage license together
  3. Set marriage appointment
  4. Get married
  5. File for AOS (K1 and K2) & EAD; and maybe AP May as well get the combo card (EAD/AP) for both K1 and K2 the cost is the same. The joint fees for K1 and K2 AOS can also be expensive, not to mention the associated costs (medical, copying, photos, etc.)
  6. ROC Application window for that is a ways down the road, opens up ~3 months before the expiration of 2-year conditional GC.

Health Insurance:

Yep, health insurance costs can take your breath away, found that out two years ago. I added my wife to my work plan after marriage. I went online and purchased a catastrophic health care plan (i.e., $1000 deductible) w/ dental for stepson for about $150/month. Check around for deals. YMMV.

Good luck on your immigration journey.

Thank you guys! This all helps so much. They arrive in 2 days!

Regarding SSN, the K2 is 9 years old. Get him an EAD anyway? Why not? It doesn't cost any extra when you file the K2 AOS.

Yes apply for the EAD for both of them, it's free when applying along with AOS. Print off the I94 for both of them after they enter the US, you'll need that at the SS office. For the K2 you'll have to go back to the SS office after they both get their work authorization cards. I asked them when I was there why a 2 year old needs a work authorization card to get a SS card and they couldn't really give me an answer but that's how they do it. If someone knows the why I'd be curious myself.

So many issues and switchbacks and hiccups and runarounds, starting to get a headache....

K1 and K2 just arrived 3 days ago, however I've been trying to lay down the groundwork before their arrival.

Called school and of course they need health clearance/physical exam

I called HMSA health insurance, they told me they won't cover them unless US Citizens/married to mother

Called a clinic and they told me they can't accept the only form of ID they possess, which are Japanese passports (and DL for mother), so the K2 can't get an appointment

Not sure what I'm supposed to do next.

Does this look right for the k1 flow?:

Get SSN > Get Married > Change name on SS card > Apply for AOS

Thank you for any advice. Getting burnt out doing all the legwork all these months and especially now that all these snags are coming up all at once.

They can't get any benefit unless you married the mother. Married first then taking care of insurance and school thing. That was happened to me. The military won't let me enroll to TRICARE unless we presented married certificate and any other docs.

You can't changed name on SSN before or at least have an EAD on hands.

can get to 'ethnic clinic' that takes small cash and get it all done there for the school?

if no, why no ?

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Ahh ok! So:

Get SSN > Get Married > Apply for AOS

No changing name for SSN, apply AOS with original country's passport name and produce marriage certificate?

You don't need the SSN to get married or file for AOS. You also do not need to wait 2 weeks after arrival to apply for the SSN. Once married and you have the marriage certificate from the court, then file for AOS.

File for AOS in married name, and include the EAD and AP for mother and child. Get SSN for child when they receive their EAD/AP card.

Ok thank you!

Get married > File AOS-EAD-AP under married name > Get SSN whenevs

We can apply for her SSN anytime after receiving marriage cert?

As for the K2 I'll: Wait until married > Get him under health insurance > Wait until EAD/AP approval > Obtain SSN > Acquire some form of ID other than foreign passport (???????) > Enroll him into school
