Timeline

I follow a few Facebook groups for waivers and I have been seeing the processing time at about 3.5 months. Two people reported 3 months in the last few days. One with a June 23rd filing date, approval Sept 23rd. Regular straight forward I-601. I guess it depends on the difficulty level of your file. I spoke to my lawyer yesterday about how they process waivers. He said he has not visited the NSC as of yet but as far as he understands, they receive them and just give them to the adjudicators. No special order. He is almost 100% sure that the Waiver adjudicators only do WAIVERS. My question was if they process all types of files....

.He is against me reading the forums . He says I should just sit back, pray and let them do their job. That's not in my nature. I like to follow the forums and groups to see the progress even though I fully understand that every case is different.

This is the last stretch of this long journey for us. 3 months will be November 22nd. We are hoping it will all be over this year. ( HOPING :unsure: )

UH60Chief, what is your receipt date? Ours is August 1st. My ceac websitesays it was updated on OCT 22th.

Our receipt date is 10 October 2014. Our CEAC first updated on 30 October 2014, which I believe was due to a congressional inquiry. It updated a couple more times in early November and now the latest update today.

Our CEAC had an update on Dec 1st and again today Dec 3rd at 11am. I know it was around that time because I had just checked it around 10:30am. ( it is a terrible feeling having to wait and not knowing a dang thing) :girlwerewolf2xn:

The congressional inquiry wouldn't update the CEAC because the CEAC is the Dept of State. The congressional inquiry is making the inquiry to the USCIS which is homeland security and the two websites are not connected. I verified that a while ago. The embassy is the Dept of State. Either way, my friend who works for the passport fraud dept told me someone is definitely entering info when the date changes. The date would not change if someone was just viewing the case.

So it is good news I suppose. I just wish they would approve our case so he can fly home for Christmas.

The refused status has nothing to do with your waive.r It will change to issued once the passport has been stamped and the visa is issued. USCIS is totally different than the dept. of State. The waiver decision comes from the USCIS.

NVC lied to me big time and after much waiting received a checklist had to send in parents marriage certificate. I have about 18 days to go to complete the 60 day wait, we shall see.

Looking for an anwser. My husband was denied his I-130 visa under 212(a)(2) A (I)(1). They told him at the interview to file the I-601. With the new law, can he come visit me, or be in the states while we file the I-601, and go back if approved? Would love to have him with me for the holidays. He has been in his home (EU country) during the I-130 process, and still is. Also, is it possible to file without a lawyer if we have significant evidence, and ability to put together the packet well? Thank you.

you don't need a lawyer but you better do a ton of research and be able to put a good package together.

and NO, he can't come here and wait.. and what "new law" are you talking about? The Obama Executive Action doesn't apply. Congress is suing Obama anyway. It probably won't even amount to anything.

We all would love to be with our spouses for the holidays. The I-601 is to waive the ban of inadmissibility. If he was able to enter the US, you wouldn't need a waiver. The USCIS doesn't care.

We all would love to be with our spouses for the holidays. The I-601 is to waive the ban of inadmissibility. If he was able to enter the US, you wouldn't need a waiver. The USCIS doesn't care.

Yeah, the USCIS really doesn't care in the least about families being able to see each other. To put it into perspective, I am a 90% service disabled veteran, while in Germany my wife took care of me and handled all of the household stuff since I am not very mobile. The USCIS will not let her step foot in the US without the I-601 waiver.

Just my 2 cents, for a waiver involving a CIMT I would at least have a consultation with an attorney that specializes in waivers (Lizz Cannon). I originally wanted to compile the waiver myself but didn't want to risk making an amateur mistake and it get denied. After consulting with Lizz, she informed us that the consulate had made an error in their decision and built a SOLID case for us. It is money well spent for the piece of mind and having a legal expert on your side.

Yep, I agree.. Our waiver is an easy one and we have tons of hardship reasons. I was not about to risk leaving something out and risk a longer process. I hired a local lawyer and he put our waiver together. I figured it would be smart to hire someone who had experience in waivers. Our expedite was approved but still we wait. This is so frustrating. :protest:
