Hello, i was wondering if there was anyway that i could revoke my American citizenship without having to go into a US embassy or consulate? If not, could i put someone as a power of my attonery from the country the Embassy or consulate is in, and have them go into the embassy or consulate with my premission and documents and they handle the process of revoking my American citizenship? I need help on this topic.

I was born in the United States, and my whole family are US citizenships they were all born in the country as well. So i was not naturalized, or immigrated to the United States.

Also the US government took my passport since i was charged and indicted in court but i ended up leaving the country anyways under a second citizenship. Is it possible to revoke my American citizenship still even though i do not have the passport? Also is it possible to still revoke my American citizenship even though i was indicted and have a warrant for my arrest back in the US?

Anyway who can help answer my questions, it would be very helpful and i would be very thankful.

Yes, i already know of those requriments, and how to do that if i show up in person. I am not looking to do that.

I am looking to see if anyone knows a way if i can make someone my power of attonery to go into the embassy, and handle the paperwork, and the oath of reunciation for me, or if i could do it by myself without having to go physical into the embassy. These are the two questions that i am asking, and i would like answered.

I highly doubt you could do it via someone else even with a poa. It is as serious as an immigrant visa interview. Don't you have access to a consulate or embassy where you are? Or are you afraid they would arrest you and get you back in the States and in jail?

I'd suggest emailing the embassy in your area and asking them those questions. They will tell you if someone can show up for you or not.

Also, i'm not quite sure what kind of motivation would make you want to lose a citizenship, but it will not make your warrant and criminal history disapear if that is the reasonning.

"A person wishing to renounce his or her U.S. citizenship must voluntarily and with intent to relinquish U.S. citizenship:

  1. appear in person before a U.S. consular or diplomatic officer,
  2. in a foreign country (normally at a U.S. Embassy or Consulate); and
  3. sign an oath of renunciation

Renunciations that do not meet the conditions described above have no legal effect. Because of the provisions of Section 349(a)(5), U.S. citizens cannot effectively renounce their citizenship by mail, through an agent, or while in the United States. In fact, U.S. courts have held certain attempts to renounce U.S. citizenship to be ineffective on a variety of grounds, as discussed below.

E. TAX & MILITARY OBLIGATIONS /NO ESCAPE FROM PROSECUTION

Persons who wish to renounce U.S. citizenship should be aware of the fact that renunciation of U.S. citizenship may have no effect whatsoever on his or her U.S. tax or military service obligations (contact the Internal Revenue Service or U.S. Selective Service for more information). In addition, the act of renouncing U.S. citizenship does not allow persons to avoid possible prosecution for crimes which they may have committed in the United States, or escape the repayment of financial obligations previously incurred in the United States or incurred as United States citizens abroad."

I think that answers your question. You can't use a third party to revoke your citizenship without appearing in person, and in particular you can't renounce your citizenship in order to avoid prosecution. Anything beyond that, I doubt anyone on the forum will be able to provide a better answer, except to suggest you contacting a lawyer.

OP appears to be on the run from the law and wants advice on how to avoid the punishment for his crimes. Already fled the country when ordered not to.

That's what I gathered as well, which is why I pointed to the clear answer in the USCIS website, which is not what the OP wanted to hear. Imagine if everyone who committed a crime could just run away and say they weren't a citizen anymore ... :no:

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
