Hello!

My K1 visa has been approved and is in the mail on its way to my house. I live and work in Canada and I am in driving distance from my Fiance. I want to visit him for the weekend and come home (due to work) but I don't want to cause any issues with my K1 visa because it is in my passport. While my visa was pending I had no problems crossing the boarder.

Am I allowed to visit and come home without using my K1 visa? or are you forced to use your K1 visa on your first entry to the USA?

If you have your visa in the passport that's valid for one entry only, if you visit and came back home you have to start the process all over, don't take the chance just wait for your visa and make the moved

So even if I say to the officer "I am not using my K1 visa for this entry, I am only visiting and I will not be staying permanently" they would still make me?

The officer decided which visa you will use to come to the US. And also, if someone has B-2 visa on the passport the US embassy will canceled it without prejudice.

~~Moved to the Canada forum, from K-1 Fiance(e) Visa Process & Procedures - As this is more Country specific.~~

Some members have had luck with the boarder allowing them in without having to use their K1. it really will be up to the guard you get on a arrival.

Vjers have reported back that they have has success,......BUT it all depends on the POE officer, simple as that

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

If that is the case he let you slide on something he is not allowed to do.

Might be the case for Philippines fiances, but it works a little different for Canadians.

When my K1 visa interview was approved last month, I was given specific information in regard to the fact that I could enter the US as a visitor without activating the K1, provided that intentions were explicitly stated at the POE. Whether the entry is successful or not is at the discretion of the CO, like all border crossings.

What they tell you at the consulate can differ at the POE...as they are 2 different people, and branches of the gov't! The POE officer does not have to let u gain entry without endorsing the visa.....What may have worked for Sweetmellissa, does not mean its going to work for you...good chance it will, but it is not a given.

It would be great if more people understood the boldfaced text. You went through the process already? Cool and congratulations. Everything you experienced is just that, your experience, and it can be totally different for me.

Whatever advice I see on this forum, I doublecheck with people who know better, like accountants and doctors, etc. People who dish out advice should offer caveats, noting their advice is only their personal experience and they are not experts in the matter.

I called the POE I will be using directly and I was told I can enter the USA with a K1 visa in my passport and I do NOT have to use it. I just have to be specific that I want to enter as a visitor and I am coming home!

In this case, in bold I shall write
You can enter the USA as with a K1 visa on your Canadian passport without using it, you just have to explain you want to enter as a visitor! :) :)
