DCPD: James Brady death ruled homicide

Virginia’s medical examiner ruled Friday that former White House press secretary James Brady’s death was a homicide, according to the D.C. Police Public Affairs office.

The death was listed as a homicide because Brady’s injuries from the 1981 assassination attempt on President Ronald Reagan contributed to his death on Aug. 4, a D.C. officer said in an interview Friday.

Brady was shot by John Hinckley during the assassination attempt and was partially paralyzed after the attack and had to use a wheelchair. Hinckley was found not guilty by reason of insanity — but the ruling brings up the possibility of new charges being filed against him.

Possible additional charges for the 59-year-old Hinckley related to the incident would be decided by the District Attorney’s office, which did not immediately return request for comment Friday afternoon.

After the attack, Brady became a lifelong advocate for gun control.

Informative article re: the legal repercussions. Apparently any actionable consequence (in this instance, "death") has to happen within a "year and a day" from the first occurence (the shooting). Makes perfect sense. Plus there's the non-trivial issue of double-jeopardy.

This is just the coroner trying to make some anti-gun political statement.

Seems strange given that Hinkley was already ruled insane and is still locked up. Hard to imagine they would take this to trial, given that nothing would change.

Sara Brady needs that on last gasp for the anti gun crowd. ....Keep his name in the public's eye as long as possible. Her cash cow just died....She is not doing that work for free.... Just like the clinton foundation..... Where is our next directors meeting.....This time ... Nice France for a few weeks at a $1000 per night hotel. The weird thing: a lowly coroner has chosen to make a brazen political statement. Not only is it not in his job description, it's specifically proscribed.

This runs parallel to cases like Lois Lerner (and plenty of others as well); I don't believe the preznit gave her her 'marching orders'; she was just a willing soldier in the war on conservatives, and thought she was somehow being helpful by illegally silencing half of the political spectrum.

Concepts such as "right and wrong" seem to mean nothing to these employees of ours.

Thanks for the link to Volokh -- I don't always agree with him (although I do here) but he's always a good read and he challenges my prejudices frequently. Even if I don't come around to what he thinks all the time, having to consider an intelligent critique that I don't agree with is good for the brain.

I don't think this is an anti-gun political statement. The cause of death is "homicide" -- that, by Volokh's reasoning, Hinckley cannot be tried for murder or a lesser charge due to DC law at the time of the incident does not change the fact that Hinckley's actions contributed to Brady's death by hastening it. There is (probably) not an action at law but this doesn't change the cause of death.

Even that much can't be reasonably concluded. Brady was 73. For men born in 1941 (his year of birth), life expectancy is 63 so he was already 'overdue'. Who's to say he didn't just die of old age, instead of a physical insult from 33 years ago? That's why there's the "year and a day" law.
