Careless Lawyer... argh, need to vent!

Hi all...

Today I received notice from our lawyer that they are filing the I-130. My joy lasted exactly 2 minutes, until I realized that:

There were a few mistakes on the I-130, and I do mean mistakes.

  • Last name of my husband misspelled, questions partially answered, etc.
  • My middle name missing on the check
  • Additional documents in the packet (that were never sent to me to be translated)
  • I made a mistake in one of the translations, very visible, at the very bottom... the lawyer simply signed and certified that she reviewed and it was ok!

I wanted to cry. I am just so upset about this. There was supposed to be three people looking over these things, and when they send us what is suposed to be filed, it is plagued with inconsistencies and errors.

Fortunately, the packet has not been submitted. But their solution is to just to put liquid paper and hand write on top of it. I just want to ask if any of you have had any issues with correcting forms this way. Please let me know as I would rather have my forms sit in these stupid lawyers firm for another two weeks than to get an RFE down the road that will set us back at least a good couple of months.

I wish I could say these things to my SO, but the truth is he feels responsible over this because he picked the law firm, and feels he is to blame. I hate for us to have an issue over other people's incompetence. I am just very upset.

these forms are fillable acrobat pdf files,

so

if I were you,

I'd take a day/evening and redo yerself,

then resend to the attorney ..

or disengage with attorney, do it yerself.

reminder - this is a D I Y web portal for USA Immigration - we have forms, examples, guides, wiki pages, and yes, subject matter experts that can help you on tough questions. but - for this site to be useful to you - Y must D - no way to skip that part.

Ditch the lawyer, lawyers mess up more things than they correct, and they aren't used to helping with cases like ours. With the advice you can get here on our forums you can do anything they can do. They're a huge scam.

I can't speak for USCIS, but I work in an office that deals with UK government paperwork and we absolutely do not allow Tipex/liquid paper on documents so I wouldn't recommend using it. I would follow Darnell's and The Dude's advice.

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

Ditch the lawyer, we used one and made us get a RFE as he never asked for passport pictures, from no-one we're doing it our selves!

I am with you all, unfortunately this is not a decision that I can make on my own...The petitioner wants to follow through with the lawyer, so I will just follow closely and review before the lawyer submits anything. For now, we received our NOA1... so that is good news. I will keep y'all posted.

Just so you know, lawyers more often than not hamper the flow of this process, as they do not chase after USCIS for you, etc. They have other cases and clients to work for. They just file your papers and collect their fees. At least if you do it yourself, you can be proactive and do the calling and the chasing you need to do to get your case moving.

I hope if you decide to follow through with the lawyer route, I hope they smarten up and work well for you. Good luck with your journey! :)

Oh same here, I mean she sent everything perfect back in march, next week will be 5 months, I dont know her but I talked to her a few times and she was a haha im giving it till the 20 of this month, if we dnt get approved I will attack them all with phone calls, but I cant said anything since my husband hired them. They just dont care, we are just another piece of paper for them and 2500 usd. Good luck wiith the process my dear paisana!!

IMO, rather do it yourself. Like what others say, some lawyers seem to cause more delay in the process... VisaJourney and other reliable websites have great information to help you throughout the process.

If not, tell your lawyer you need to review the forms and docs before they send it. Goodluck!
