My girlfriend in Ireland may be pregnant. Just out of curiosity, does that change or expedite anything in this process? We're hoping she's not pregnant yet, of course, because we want to be together through the process. Any help is appreciated. Thanks.

If the child is born before she gets her visa, it does add to YOUR family size for the poverty level. So instead of two, you now must make enough for a family of three.

I know we all want to be with our loved ones but make sure you find out for sure if she is pregnant or not. You can still be there for her (not physically) but emotionally by communicating everyday. Eventhough it is not an expedite, I wish you two well and good luck

Please fill in your timeline. ? are you going through TSC or CSC? I'm asking because we just went through Dublin and the process from NVC sending your petition to getting your visa in hand can be ask quick as a month and a half. Our entire process from mailing the petition to him having his visa in his passport was 4.5 months. We went through CSC. Good luck!

My wife was pregnant while waiting K-1 visa, she got approved by the end of January after applying for it on September then she flew to US on February and baby was born in March.

Expedited? No, simply we were lucky as I wish the same to you.

Hi,

Like other posters have said, it does not change anything. It might come to question though during the medical exams. If she is for sure pregnant then you will have to send her with a formal consent that you are aware of it. If you don't, the medicals will report it to the embassy and it will come in question during her interview. They may want to contact you after the interview to find out if you know about it (some people have had *outside pregnancies which their fiancee were not aware of).

So, if you have a written consent with her during the IV interview then it won't be necessary to have additional time to contact you.

nooooooooooo i am 6 months pregnant,i lived in a hope that i will get a visa and go by the time i am due,but its not happening 4 monts later and still no noa2

i am alone all this time,its really hard,its hard enough if its your first baby and 2 times harder if u are alone through all the process

from my expiernce i hope she is not pregnant,yes i love my baby he was not a mistake,but if i knew what would i go through being alone i would think harder

Lets hope the baby is born after your fiance gets to the US. Otherwise you might need to file extra paperwork to grant Us citizenship to your baby. On the plus side, the CO will have no doubt about the 'bona fide' of your relationship :-)

Birth Abroad Out-of-Wedlock to a U.S. Citizen Father – “New” Section 309(a)

A person born abroad out-of-wedlock to a U.S. citizen father may acquire U.S. citizenship under Section 301(g) of the INA, as made applicable by the “new” Section 309(a) of the INA provided:

  1. A blood relationship between the person and the father is established by clear and convincing evidence;
  2. The father had the nationality of the United States at the time of the person’s birth;
  3. The father was physically present in the United States or its outlying possessions prior to the child’s birth for five years, at least two of which were after reaching the age of 14.
  4. The father (unless deceased) has agreed in writing to provide financial support for the person until the person reaches the age of 18 years, and
  5. While the person is under the age of 18 years --
  • the person is legitimated under the law of his/her residence or domicile,
  • the father acknowledges paternity of the person in writing under oath, or
  • the paternity of the person is established by adjudication of a competent court.

Birth Abroad Out-of-Wedlock to a U.S. Citizen Father – “Old” Section 309(a) of the INA- A child born out-of-wedlock to a U.S. citizen father may acquire U.S. citizenship under the former Section 301(a)(7) of the INA as made applicable by the “old” Section 309(a) of the INA if the U.S. citizen father, prior to the child’s birth, had been physically present in the United States or one of its outlying possessions for ten years, five of which were after the age of 14, and if the paternity of the child had been established by legitimation prior to the child reaching the age of 21. The “old” Section 309(a) of the INA is applicable to individuals who were 18 on November 14, 1986 and to individuals whose paternity had been established by legitimation prior to that date. Individuals who were at least 15 on November 14, 1986, but under the age of 18, could opt to have their claim determined in accordance with the provisions of either the “old” or the “new” Section 309(a).

OK, I am going to be pedantic here. She is NOT your girlfriend she is your fiancee now.

It may seem to be a semantic argument but when it comes to dealing USCIS and government bodies you need to be precise.

Next, as most Americans are blind to the fact there are two separate countries on the Island of Ireland, can you be more specific as to where your fiancee is.

If she is from Northern Ireland, she has access to free health (which is still quite good in NI) for herself and her unborn child. If the child is born in Northern Ireland all she has to do if file a CRBA at the American consulate in Belfast. A painless and fairly swift process.

This confers US citizenship on the child and a US passport can be obtained at the same time. This is what I did for my two children.

The Republic of Ireland's Healthcare system is like the US. Insurance a must I understand. I am sure someone here on VJ can fill you in on the details. But again if born there a CRBA can also be filed at the American embassy in Dublin.

To answer your question, being pregnant is not a reason to expedite.
