5 years? What visa are you adjusting from? What have you done already in the last 5 years to try and get your case processed? If you are paying a lawyer, then why have they not tried to get your case adjudicated already?

Well, came with B2 visa. Then met my husband, got married. Have lawyer. Lawyer filed 3 times initial evidence trying to push case, how he said.

But still ... 5 years? Did you mean you submitted your I-130 and I-485 on 2009? Did you get a USCIS Receipt number from your lawyer? You can actually check with uscis yourself if your application is still active if you have the receipt number.

Should not take 5 years for an adjustment from a B-2. Your lawyer should have been letting you know step-by-step what is going on with your case. Call the USCIS and speak to a tier 2 immigration officer on your own and/or make an Infopass appointment to go and speak to one in person about your I-485 status.

I check case status on regular basis. Saying-- Initial review. Lawyer has something with immigration office,because his intern from his firm works half time in immigration office!

I will call directly to the USCIS and speak to a tier 2 immigration officer.

Just curious, when was the last update done as per uscis status?

I think you're better off firing your lawyer....anyway, five years is insanely long, even if you were out of status since you were 5 years old (when applying for AOS at age say 25)!!! Make an infopass, this is so wrong. Your biometrics are long time not valid (if you actually ever got to that phase). For us it took literally two months for the whole AOS, not 5 years!!!! That's insane...I am so sorry to hear that, it sucks big time!

So, situation is: if I fire the lawyer, what documents can I file alone and when? Should I wait, wait and wait?

As I been saying, lawyer's staff work in local immigr office. Once he mentioned MY case pending in local office. I asked:Why? He explained it is procedures! Hard to believe!

I'd get all the info from your appointment, find out what has been filed and when, what is still current and valid and what you need to so to AOS.

Then, fire your lawyer, do the AOS yourself (and if your lawyer has made a real mess get a different one!!), and possibly sue your lawyer (if that piece of advice violated VJ's TOS I apologize, certainly not my intent).

To specifically answer your question will depend on what the appointment says - but you can file all the forms to adjust your status yourself: I-130, I-485, I-765 (EAD), i-131 (AP).
