When do we have to get married by?

Hi all,

Just looking at the K1 VISA that they printed in my passport it has an expiration date of 8th May. I remember being told that I had to travel by the 8th of May but I just need to make sure that I have remembered correctly.

I also think I was told that we have 90 days to get married after moving to America. Has this been the experience of everyone else on this VISA?

You are correct. 90 days. And it is strictly enforced so don't let it go to 91.

A K-1 requires you to be married within 90 days of PoE, which is the same date as should be on your I-94. You will be out of status from that date until you file for AoS.

Yes, you have to use the K1 visa before it expired and you have 90 days to get married when you arrive in USA.

I don't remember it saying that you are out of status until you file your AOS.

If you arrive May 7th, then you have 90 days from that date to get married.

That's about right. K1 is used as a single entry visa with a 90 day validity. You must use it and travel before the expiry date, marry within 90 days from entry and file AOS. In most cases, the validity runs out before AOS but what is important is you marry within that period.

Wow, that's pretty close to the date for travel. I don't know how long the flights from the UK to the US but make sure you should be in the US before May 9 otherwise your visa is not valid anymore - someone can corrected me if I am wrong-.

Yes, you have to get married within 90 days from your arrival. I got married 7 days before my I-94 is about to expire. We did it because I chose a good day to get married and close to my birthday.

They are all correct, it is within 90 days of you or your fiance(e) from stepping foot on US soil via the K1 visa.

Your entry date into the US should be no later than the expiry date on your visa. If it expires May 8th, you'll want to be sure you land on May 8th... They do not fool around with visa expiration dates. You will very likely be shipped right back if you go past it even by a couple hours.

As a side note, I would recommend giving yourself at least 10 days wiggle room. In case there's a paperwork mixup. Going down to the wire is never good.

Anyone that has an I-94 with a defined expiration date is out of status beyond that date, and a K-1 is no exception.
