Hey,

My fiance and I were wondering if it was possible for her to have her interview in the US rather than in London. Here is the scenario... our K-1 Petition was accepted and we received our NOA1 on 3/14/14. So with a six month wait time figure we could be approved visa in hand by 9/14/14. I am going to visit her in London in July and we thought it would be great if she could just come back to the US with me on a 90 day tourist visa and stay with me for the duration of our wait time. Practically speaking, even if the visa took 7 months instead of 6 she would still not have overstayed her welcome in the US.

So the main question I guess is, can a foreign fiance receive their visa and go on their interview while already in the USA as a tourist?

Any guidance would be great!

Thanks,

Gary

No. The interview is conduct at the US embassy/consulate. There is no the US consulates/embassies in the US soil.

Nope.

Well, let me elaborate. She can come to the US on the tourist visa, likely VWP, which is 90 day maximum while the petition is processing. However, after the 90 days, she would have to go back, and there is no such thing as an interview in the US, so she would need to have the medical and interview in the UK.

No, London it will be.

Yes, they can leave to their country and have the interview at the US Embassy in their country. Then they can return using the K-1 visa. Easy - Peasy

Any guidance would be great!

Thanks,
