N-400 Part 1 - option 1 or 2?

Hello everyone,

Quick background: My wife entered the US on August 2008 with a K1 Visa on my petition - We got married the same month - She became a Permanent Resident on March 2009 - Now she wants to apply for the Citizenship and we just want to make sure she picks the right option on Part 1 of the form.

She's been a permanent resident for 5 years and 1 month.

She's been married to me (US Citizen) for 5 years and 8 months.

Which is the best option to choose between the two on Part 1 of the form for her situation based on the information I provided?

Part 1. Information About Your Eligibility

1. __ Have been a Permanent Resident of the United States for at least 5 years.

2. __ Have been a Permanent Resident of the United States for at least 3 years. In addition, you have been married to and living with the same U.S. citizen spouse for at least 3 years, and your spouse has been a U.S. citizen for the last 3 years at the time of filing your Form N-400.

We're not sure how to pick the best answer because both seems to describe her eligibility. She's been a green card holder for over 5 years AND she also became a green card holder based on marriage to me 5 years ago? Does option 2 only applies to early filers(3 years)?

You can pick whichever one you like. It affects nothing because She'll have to bring the marriage certificate anyway as that is how she became a GC holder. Good Luck to Her!

Never Received  - NOA 

01/18/2018 - I-551 Stamp (Day 305)

06/26/2018 - Case was transferred to NSC. (Day 463)

08/03/2018 - Received 18 month extension letter. (Day 501)

09/01/2018 - Submitted N400! (Day 530)

 

N-400 Citizenship 

Permanent Resident Since: 05/20/2015

Local USCIS Office: Oakland Park, FL 

Applied Online. 

 

09/01/2018 - Application Submitted Online (N-400)

09/07/2018 - Received physical copy of app receipt in the mail. (Day 6)

09/08/2018 - Biometrics Scheduled. (Day 7)

09/27/2018 - Biometrics appointment. (Day 26)

06/21/2019 - Interview Scheduled. (Day 293)

08/10/2019 - Interview - Passed. (Day 343)

08/23/2019 - Oath Ceremony!!! (Day 356)

Just my opinion, but Option 2 best descirbes your current situation. Again, just my opinion, but if you had divorced within the first 3 yrs of marriage Option 1 would be best. Moreover, your gal entered as a K1 you guys married and are still married. As stated in the instructions, Option 2 is for married people and Option 1 is for unmarried/divorced people.

Option 1 is much better. It's processed much faster than Option 2 since it does not require proof of marriage. I was qualified for both options and selected Option 1 and seems like I'll be done in less than 3 months. In other threads, someone was mentioning that immigration officer changed the selection to Option 1 from option 2 at the interview. Less work for them as well.

Option 1 is the way to go. There's also less paperwork to file (no marriage cert, no proof of spouse's citizenship, no IRS transcripts, no proof of terminations of previous marriages).

It's less work for you and it is simpler overall.

Actually, even with Option 1 you still need to send proof of terminated prior marriages if any with the application.. They want to make sure one is not married to two people at the same time. And in the interview the officer made a copy of my current marriage certificate (it wasn't needed to be sent with the application itself)

Hi, I qualify for both option 1 and 2. In the US for 8 years but came after marrying an American, that I am still married to.

If I go for option 1 (been here for 5 years), I only need to send a photocopy of my Green Card and a check. No marriage certificate, right?

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
