Feds release all cows gathered during NV roundup

Federal land managers confirmed they released all 400 or so head of cattle rounded up on public land in southern Nevada from a rancher who has refused to recognize their authority.

The Bureau of Land Management took the action Saturday afternoon after hundreds of states' rights protesters, including militia and tea party members, showed up at corrals outside Mesquite to demand the animals' return to rancher Cliven Bundy.

The bureau issued a brief statement saying the cattle were released "due to escalating tensions." Some protesters were armed with handguns and rifles at the corrals and at an earlier nearby rally.

Las Vegas Police Lt. Dan Zehnder said the showdown was resolved with no injuries and no violence. Clark County Sheriff Doug Gillespie was able to negotiate a resolution after talking with Bundy, he said.

The release came only hours after Bureau of Land Management chief Neil Kornze announced an abrupt halt to the weeklong roundup because of safety concerns.

The fight between Bundy and the Bureau of Land Management widened into a debate about states' rights and federal land-use policy. The bureau revoked Bundy's grazing rights after he stopped paying grazing fees and disregarded federal court orders to remove his animals. The dispute that ultimately triggered the roundup dates to 1993, when the bureau cited concern for the federally protected tortoise in the region.

Kornze's announcement came after Bundy repeatedly promised to "do whatever it takes" to protect his property and after a string of raucous confrontations between his family members and supporters and federal agents during the weeklong operation.

"Based on information about conditions on the ground and in consultation with law enforcement, we have made a decision to conclude the cattle gather because of our serious concerns about the safety of employees and members of the public," Kornze said in a statement.

In 1877 Nevada was considered a wasteland by the Government and It was common law that if someone owned the water rights they also owned the grazing Rights, this was done to let the people make something out of uninhabitable lands. And until 1993 no one ever questioned The Bundy's rights to graze cattle or how many they grazed. Given the brutal environment it is obvious that the Bundy's are outstanding managers of those lands. In the early 90's Las Vegas was booming and they realized that they were running out of water, and would not be able to sustain the growth. The Pine Creek ranch was the crown Jewel for Water as the water rights were extensive, And the political clout in Vegas did there best to run Wayne Hage off of his land to steal his water, as they have done this to several ranchers all ready. But they were out smarted by Mr. Hage and his intelligence. He has won every Trial and appeal and has yet to be awarded the judgment. Mr. Bundy was a different matter as he was well aware of his rights, as his neighbors were ran off he just ignored the BLM as they did not have any legal right to tell him anything, as the precedent was set with Hage v USA 1993 as he Owned the land before 1900. Now with the Drought and a renewed economy Las Vegas needs more water and they are coming after everyone that owns water rights in Nevada. On June 6, 2008, a federal judge in the case of the Estate of Hage v. the U.S. awarded the estate of Nye County rancher Wayne Hage $4.2 million in damages plus interest, attorney fees and costs in compensation for the federal government’s Fifth Amendment “taking” of grazing and water rights. Hage had died two years earlier almost to the day.

On June 5, 2012, federal Judge Robert Jones in Reno in the case of the U.S. v. the Estate of Hage began civil contempt proceedings against Thomas Seley, the field manager of the Tonopah office of the Bureau of Land Management.

The battle began in 1979 and wages on and on and on.

Jones stated from the bench that Seley, who became head of his office in 2007, “undertook a pattern to obtain his own remedy in derogation of this Court’s jurisdiction over these issues, and that’s the contempt.” The judge accused Seley of trying to interfere with water and grazing rights, as well as filing trespass notices despite the matter being in the jurisdiction of the court.

The 2008 Hage v. U.S. ruling included this strongly worded conclusion:

“The taking clause was not written to protect merely against frivolous exercises of governmental power, but more precisely to protect against the opposite. Presumably, the political process protects against most frivolous exercises. The protection of the Fifth Amendment is most needed to protect the minority against the exercise of governmental power when the need of government to regulate is greatest, and the desire of the popular majority is strongest. In this way, and in this way only, does the judiciary properly affect policy, and that effect is to adjudicate the limits that the rule of law and a written Constitution impose upon popular government. The existence of property rights, not the judiciary’s finding of a ‘taking,’ impose these limits.”

But the government is a deathless beast that can carry its fight on for generations until it has vanquished or outlived mere mortal citizens.

According to a Nevada Journal article, the fight began in 1979 when Hage ran into federal agents on his grazing allotment who were surveying the area so the Forest Service could file a water rights claim. Hage’s ranch had held those waters since 1865, before the Forest Service was created.

The government later claimed Hage was overgrazing the land and canceled his grazing and water rights permits for five years.

According to court records, in 1983 Hage received 40 letters from the Forest Service charging various violations and agents of the Forest Service visited the ranch 70 times. The Forest Service then filed 22 charges against Hage, many for extremely minor infractions. “In addition, the Forest Service insisted that Plaintiffs maintain their 1866 Act ditches with nothing other than hand tools.” (Welcome to Tombstone.)

In 1991, the Forest Service twice impounded Hage’s cattle. When he could not get them back by paying the cost of impoundment, the government auctioned the cattle for $39,000 and kept the proceeds.

Hage filed his federal “takings” suit in the fall of 1991 — 21 years later …

Not only that, but the very nature of the thread goes against all the made up stories that there is a conspiracy afoot and that the police is working under direct orders from Obama to subjugate every last person in the US... You know the spiel...

It seems that the Feds backed down from what was a non-issue to begin with...

I'd say this is good evidence the laws are at work in these United States...
