im a newbie and this situation hopefully wont pose a problem for my fiance but he used to smoke regularly recreationally but really it just helped him sleep. he isnt an addict but should we be worried? should he be making sure he has months free of use to prove no addiction or has anyone got any advice? we planned on marrying next month small civil ceremony while he intends on continuing to work and maintain residence in Canada until he gets CR1.thanks

sorry im american citizen living in usa. hes canadian living and working in canada

March 26, 2009: We become a couple!
September 10, 2009: Arrived for first meeting in-person!
June 17, 2010: Arrived for second in-person meeting and start of travel together to other areas of China!

December 8, 2010: Wedding date set; it will be on February 18, 2011!

April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)

July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package

Correct. Time to actually read the questions on the DS260. Although that's an online form, you can download the DS230 which has essentially the same yes/no questions. Read them all carefully, as he'll need to carefully answer each.

Marijuana use needs to stop yesterday and at least until immigration processes are complete.

yes, thats already the situation...hes not using for extended period of time just didnt know if this automatically was tested for and if (for lack of a better word) his sobriety from any recreational drug would be tested automatically...some one mentioned their urine, hair, blood was sampled and my understanding that this can show use in distant past....just didnt want to go into this without thoroughly understanding what may happen. this discussion of course is second hand and im not implying by this question that hes committed a crime or that hes using...sorry for any confusion...

You must also focus on the question on the form, which he will be answering under oath, not just whether he'll be tested and caught lying. Please understand the penalty for making a material misrepresentation is far worse than the penalty for using the substance.

Only blood is taken at the Canadian panel physicians.

The questions on the form leave open the interpretation of the word "abuse" but the word IS abuse, not use. The problem is that US federal law tends to equate use of an illegal substance to "abuse", simply because it's illegal. I expect visa applicants use their own best understanding of the meaning of "abuse".

This doesn't sound like abuse or a disorder, but like a mild example of what would pass for medical marihuana use in a growing number of states. It seems "no" would be the most appropriate answer to that question on the screenshot of the form.

If he does decide to disclose it, maybe put a "medical" spin on it rather than calling it "recreational"?

& One day the law will catch up with reality!

Most states now have legalized medical marijuana. All he needs to do is pay $200 and get a license from a doctor (many do it) and he can legally buy from a dispensary in many states. Because it is becoming legal in so many states in the USA I do not see it as a problem.

Also - if he lives in Canada I believe medical marijuana is legal there -and as he smokes in Canada and lives there - when he fills out that form he will NOT be committing any crime by stating that he does in fact smoke pot.
