Hello VJ and thank you stopping by!

My name is Melissa, the Canadian beneficiary and Sam the USC petitioner and we're staring a mound of paper work! Not to worry we have most of it done. :)

We've been together since 2009, visiting regularly back and forth. My visit to him in October ended with us having a surprise wedding on Halloween. I'm currently in the united state with my husband trying to file for the CR1. I didn't enter on a fiancée visa, I drove over the border for a visit and ended up getting married.

We have the following forms completed.

I130

I325a- one for him and one for me.
I485 -aside from part2.

I539

I864 - one joint sponsor and the petitioner

I639 - completed and sealed by the civil surgeon.

What I am a confused about is this.

On the step by step guide for a spouse inside the USA, it says to file for the i485, but for part 2 I cannot find a section that I fit in. I didn't enter or marry on a k1. There is an other section, but I'm not sure as to what I would put. The i539 seems more fitting for my situation, but this package calls for an i485. I should also add, that I dont have an i94 and I would like to remain in America while the process goes through.

I-539 is only if you wish to extend your stay or change to another nonimmigrant status. You wish to immigrate thus the I-539 is not relevant.

For part 2 on the i485 what would I check off. There are eight choices. Any thoughts? :)

You are filing for adjustment of status, not a CR-1.

well, I am doing the cr1 but I have to file the petition packets. I font quite follow the whole process yet.

No you're not doing the CR1. CR1 means you are doing consular processing outside of the country. :) And it's not a big deal, i got the mods to move it so you'll get the most help for what process you're doing. :D

You are doing "Adjustment of Status." It means you are adjusting from tourist status, in your case, to that of Permanent Resident, from within the US. You will never get a CR-1 visa or any visa. You will go straight to Permanent Resident.
