Yes, if you define "right away" as enough time for the mail to arrive, be delivered to the correct adjudicator, and him to put down his other cases and go back to yours to review again with new evidence. It won't be the day after you mail it, but it could be 2-3 weeks. If faster, then lucky you.

I'm going to assume that an affidavit from him which was missing is the cause of the RFE. When the lawyer wrote up mine it basically had a summary of our relationship and intent to marry in 90 days. So is he supposed to write up the same thing? Or just state his intent to marry in 90 days?

If the RFE is in relation to the missing letter of intent, then it only needs to be a basic letter stating that he intends to marry you within 90 days. We used the VJ template as the basis for our letters and was fine (link below). Hopefully that is all they are after since it is a relatively easy thing to provide.

So does this mean hes already done with the background check, and other things. So it won't take long?

Yes. Tell him to replace that info there with the info and names from you two, ask him to not forget to sign by hand, and mail to you ASAP.

At least you got your RFE. Ours was supposed to be sent on Dec 18th. Its now Feb 8th and nothing has arrived.

You need to chase that down or you will be denied for abandonment. They usually are good for 68 days, so your denial is imminent.

Corvus, you are experiencing the very reasons why most everyone on this site suggests NOT using a lawyer unless you absolutely must. Your lawyer is supposed to help you avoid getting an RFE, and for something so basic as a letter of intent it's a travesty. You should have your lawyer's head on a stick. A letter of intent is a simple statement that can be typewritten and signed. There are examples on this site.

You WILL need an original copy from your fiance. They can copy and print it on their end. Go personally to your lawyer's office and insist that they pay for overnight mailing fees. It's probably under 75 USD. Just get the billing from your lawyer. Also, make sure your lawyer pays the overnight fee to USCIS via FEDEX or UPS with tracking. Not US postal service.
