Malta think of it as a pause not a period...as Pinkriton says

the Gov . can do nothing, front-load, send him a few snail-mail

missing U cards, I see you are visiting around Easter time , take

pictures with family members and other friends, and get marry

there's nothing to appeal if weeds in his system or not. I'd have him get

the arrest record if there's none he should go speak to arresting officer

(Oh its on record 4got).

You Malta should do a consult in the US B4 coming to Jamaica,

so U can have an understanding of things better, also advise B/F

there's a Legal Aid Clinic in Kingston that charges minimal fees and

they assign an atty to U, this atty can look into the matter because

with the laid back attitude in the system I don't think your BF can do it

himself...They are located at Tower Street between East & Duke Sts

and they charge a small fee, they do not/cannot touch US immigrant

issues it just to get the criminal arrest sorted out.

The fact that he'd been petitioned B4 did not help the weed arrest. I say

make your arrangements for a wedding a put your ducks in row ...good luck

If you love him, marry him, and file your I-130..,.,.,I do not like I-130, as K-1 is most of the time, so much quicker, but you have no choice, but your I-130 needs to address all the problems you know about, best of luck, marry be happy, re-apply, and try to get here when you can.

From what I have seen friends gone through... your next option is marriage. However, be vigilant on taking care of and amassing the things that would proof your bonafide releationship with your fiance and soon to be husband! Good Luck

A little over a year is long not enough to prove you have a relationship? That is outright stupid! Somthing is "fishy" about that.

Until recently I was seeking a K1 for my Burmese fiancé.

2012 09 27 First date
2013 01 01 Started cohabiting, and obtained a joint bank account
2013 07 13 Engagement
2013 10 11 Sent i129F to USCIS
2013 10 18 Received NOA1 from USCIS
2013 11 12 Received RFE notice - Almost decided to change the venue to Thailand. Sat on the RFE for about three weeks before proceeding.2013 12 20 RFE answer package received by USCIS
2013 12 23 NOA2 received from USCIS
2014 01 14 After demonstrating the hate Americans have tward the chidfree, my fiancé has no desire to visit the USA.

Going forward, I will sell off my remaining assets in the USA. I doubt I will ever return. Americans are second only to the French when it comes to rudeness.

Are you sure the denial, wasn't because of his police record? http://www.visajourney.com/forums/topic/468988-immigration-lawyers/#entry6685916

If that's the case, would the officer have told her it was because of lack of evidence of a bona fide relationship?

Not sure but the officer said he was not all concerned about that and he said its because he had a previous fiancee application that was still open...when I finally talked to the USCIS yesterday the lady even said outs should not have made it to Jamaica and wondered why no one closed out the previous one since there was no updates or inquiries

I think the interviewer told you that to avoid the issue of the arrest. Evidently you did not know about it, and that is why he or she felt you did not have a real relationship.

I lived in Arizona most of my life. A huge number of Mexicans lived there illegally. Why can they not get a visa? Any and all drug charges make them inelegance. Sorry, but that is how it works.

Until recently I was seeking a K1 for my Burmese fiancé.

No his previous one was not cancelled sat in the system for over a year with out any updates and the tier 2 lady apologized because she said mine should have stopped at the NVC and one if them should have been cancelled out. At the interview the officer said he denying both applications so it will close the previous one out and we will have to re start the process.

As far as his charge there is no police report to validate the charge and that does make a relationship valid.

Pointless to appeal. Nothing to appeal ,and most likely it will be allowed to expire before yo could get action on the appeal anyway.

If you love him and want to make it work. My advice get married, if possible live with him for 6 months or more, file 130
