Timeline

Well the long awaited day came today and....DENIED!! Given reason " not enough evidence to prove a bonnified relationship".....now what? Can we appeal this? Do we have to start all over? Should we get married and do the other type of application? Help please & Thanks:/

List all the evidence you submitted with petition, and what you had at interview, so that we can look at everything. Were there any red flags, such as divorce, children, proof of trips, etc...

Timeline

Most K1's will be declared expired by the time they get back and are up for review. A few ( very very few) may be reaffirmed. About the same number they will send a NOIR which will give you a change to refute the findings . You can wait for more than 6 months to find which happens. If you don't want to wait, you can presume the expiration if it has been more than 4 months since approval and file a new better K1 or go and marry.

This will not be over quickly. You will not enjoy this.

We have submitted a years worth of phone records, pictures if us on every trip there, proof of every trip which is approx every 3-4 months, I was divorced but its been years on that. He had a previously submitted fiance visa a few years back that was brought up so I'm guessing that was a huge red flag which led to the denial...my opinion! It was denied today do I leave alone and get married in April when I go again or do I file an appeal?

Thank you for linking us to the issue. they might deny you base on that drug abuse and simply stated not enough proof of your relationship

K1 (I-129F) petition filed in August 2013 (Approved Feb 20th 2014)
13th May 2014: AOS (I-485) & EAD/AP combo card
21st May 2014: NOA 1 and biometric letter
11th June 2014: biometric appointment
13th June 2014: RFE received via mail
16th June 2014: replied to RFE
6th August 2014: EAD Approved, AP still in initial review
12th August 2014: got tracking number for EAD
( ) August 2014: Received EAD (I forgot what date I got them but I did receive them less than 5 days from the 12th)
10th September 2014: Interview Waiver received (I wished I was interviewed)
April 23, 2015, we registered your permanent resident status and mailed you a Welcome Notice

The drug charge was not of concern per the officer because its of less amount than cigerette were his exact words. He was concerned that we only were dating for a little over a year and he had a previous application filed a few years back but at the end denied him and the letter stated due to lack of evidence of a bonified relationship.

So do I try to appeal that or can I just get married on my April trip and start that process? How does a denial work?

You cannot appeal. There is nothing to appeal, the IO felt that due to his last petition and now yours he is looking for a visa, and felt that your evidence did not provide proof of a strong relationship. When denied petition is sent back to USCIS.

If you marry, you will face the same issues, proof of bonafide relationship, and previous petitions. You will have to overcome these issues. It is better to frontload proof of relationship with initial petition than bring to interview.

So do I front load proof by pleading my case to the Jamaican government? I feel like this is a hurdle I can not overcome and I'm getting so exhausted and I love this man with everything I have. I am truly at a loss and the more I read the more I get confused but I don't have time to waste....what or who do I contact to get somewhere

There is no one to contact. unless they are requesting additional information, your petition has been denied. look up your case on ceac and see what it says. Right now you need to focus, regroup, and wait for official denial letter. in April, work on pictures with his family, friends, his home environment and other proof of relationship. IO gave you a hint, they believe there was no time in your relationship from the time he was last denied, and then you filed. Take some time in your relationship, plan your JA wedding and then get married. Have a timeline of your relationship. Look at it, if you believe that a stranger would question your relationship, then the IO will.

Thanks for the words of wisdom...yes I need to regroup because right now I feel like throwing in the towel and overcoming the heartache of a break up:(

I am so sorry that you are going through this. Its a shame that these people are not in your shoes that gave you the denial. They don't realize how much u want to be with the other person. They just go right back to their everyday lives like nothing happened. My fiancée goes to his interview next month and I wouldn't know either what I would do if he would get denied. Best of luck to you both in the future.
