hello room am bj by name and am new to this forum i need a help and some question to answer am from Nigeria and i got married to an America citizen last year oct and we have filled for k3 but the petition has not being approved and she is planning for me to come to the state my question are can i visit usa why my petition is still under review and if yes how can she go about me coming to the state to visit like what are the document she will need to send me in Nigeria for me to apply for visa to visit her?

K3 is effectively defunct, and you apply for a Visitor Visa, nothing to do with her.

A very long shot from Nigeria, but no harm trying.

First, welcome to the forum. Being from Nigeria you have almost no chance of getting a tourist visa to visit the US. Not impossible, but Nigeria is a very, very had country to get even the K-1 or spousal visa from as there has been a high amount of visa fraud in the past and you are paying for that by not being able to get a tourist visa. Save your money and have her visit you in Nigeria or in a third country you can get a tourist visa in order to visit.

Yes you not your wife can apply for the Visitor Visa B2. Go to the US embassy website. They interview in Lagos and Abuja. But the likelihood to get a Visitor Visa from Nigeria especially now you have a petition in the system is almost a 100% denial for you.

There is nothing she does the B2 visa is all on you. You have to show strong ties to Nigeria. Convincing the immigration officer at interview you plan to return which is very hard to do from Nigeria. She doesn't do anything no sponsoring nothing. You have to show stronger tie to Nigeria than you do to US which is almost impossible since well you are married to a US citizen and showing intent to immigrate

Obviously you submitted a I-130 and a I-129F to try for the K3 but that really is an obsolete Visa and not issued through Lagos. Once you are approved and your petition (I-130) gets to NVC they will close the I-129F and you will be going down the Cr1 path.

Nothing is stopping you from applying for visitor Visa who knows miracles do happen and it will not effect your petition in system. Just be honest why you are visiting. But be prepared for denial.

That has nothing to do with a B2 visa. None of that is asked for and would actually make your case look more like your ties are all in US. You need to show you have money not her. You have to prove you are returning to the country your wife showing all the evidence is nothing. Not even an invitation letter will help. Go read the application so you know what you need to do. Usually for many over $35000 in a 9ja bank helps,. Full time student. A very well paying job with letter from employer on your return. Taking care of family if you have kids. Its all like i said you and your ties to Nigeria.

And no you applying does not effect your petition. Whether denied or approved no matter long as you are honest.

Her affidavit of support will hurt your prospects of a visitors visa. The form is to guarantee that you will take care of the name IMMIGRANT and you are trying to prove that you want to visit and not immigrate. Your spousal petition will take about a year with no snags and until then it is most likely her that will be travelling to visit you.

This will not be over quickly. You will not enjoy this.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
