I had a fiance last year in 2012 and filed a K1/K2 for me and my daughter but our relationship didn't work out and since then we don't have communication anymore. After a few months my friend introduce me to the friend of her fiance who is an American citizen also.

He courted me and then he became my boyfriend. he always visited me and he proposed to me, after 3 months we got married here

in the Philippines in May 2013. My loving husband filed I-130 and now it is in Texas Service Center.

We are worried that my previous K1/K2 would affect the I-130 that my husband filed in the US.

Is there anyone here that experience like this before?? Please help me. It is a mind boggling..

Any advice would help a lot... Thank you!!! :)

Very likely this will be a problem as that's a straight red flag to looking for ways to immigrate into the US. I know 2 people (both Philippine girls) who had this problem in 2007 and 2011 as they both had prior 129f's and it was denied for moral turpitude.

The only solution is to have your new boyfriend send conclusive proof the relationship is genuine like 1-2 years lived together with you or 5+ trips of 1 month or more.

It all depends on your luck with the officer who reviews this. But with Philippines being a high visa fraud country, 2 129f's in a short amount of time certainly don't help.

But don't lose heart, just make more evidence for the reviewing officers, (boarding passes together, multiple vacations together, etc).

Find your ex and have him cancel the i-129f. It is a red flag having 2 different guys file for you within a short period from each other.

This is like the 3rd post on a month from a woman in the Philippines who is in same situation.

OP search VJ there are a lot of this happening at your embassy and if its not cancelled its going to be an issue. So do your due diligence now to avoid issues later.

My ex-fiance did not cancel the K1/K2 and i don't have communication with him anymore.

My husband visit me here in the Philippines every month when he have off from his job and he just left back to the US last night.

We love each other and his Dad, my father in law is a lawyer and wants to get involve in the processing if there would be a problem.

Before we got married in May 2013. We talk to a US Consul in Cebu and we told him that i had ex fiance filed a K1/K2 for me before

and he told us that we don't have to worry because once we got married that I-129F that filed of my ex-fiance before will be cancelled

and they would accept ours because we are married.

Now me and my husband are worried if the previous I-129F will be the hindrance to our I-130??

The Cebu consul you spoke with is not the same person who will conduct your embassy interview, so don't rely solely on his advice. Sure, your i-130 will most likely be approved BUT the final decision for visa issuance will be in the discretion of the consul who will review your case during your interview.

Your previous i129f will be a red flag. Be prepared.

Your ex must withdraw/cancel the K1 application. He's the only one who could do it.

Yes.. There is a US Consulate in Cebu.. My husband got his Legal Capacity from that Consulate in Cebu before we got married

and the Consul we talked to was the one who issued the Legal Capacity to Marry...

He told me and my husband during that time,

that the I-129F will be automatically cancelled after a year and it's over a year already...

Can it be really automatically cancelled?? Thankss

Only the petitioner can cancel. It will be an issue at your interview, and you will be questioned about a petition in 2012 and another petition in 2013, with different US petitioners. There is no legal procedure to make the petitioner cancel the petition either.

Just wondering... you had I29F before and I130 now, I hope it'll not be a big deal. The fact is , if it was approved, then you have your infos in the system now,.. And on the forms , there will be questions of previous applications. I don't think it'll automatically dissolve , some had their applications like 6 yrs. ago and still questioned and denied for it. But the consul always has the final say.

I read all this and I'm going to agree with what the Consul qoated. There might be a question or two. You are Married and the 129-F definition was never completed so it is Null and Void!

The ones in Cebu is just an American Consulate office..the office is located at Waterfront hotel in Lahug
