Hello everyone,

Today I receive a pink letter from USCIS... Which said: Request for Initial Evidence.

" Submit a complete Federal Income Tax Return submitted to the Internal Revenue Service IRS from the petitioner/sponsor on form I-864, Affidavit of Support, for the most recent tax year.

The most recent tax year is 2012, but 2013 is almost gone.

What do we actually have to do?

Hey!

We sent 2010,2011,and 2012 tax return... 2012 is most recent, considering you would have to wait to submit a 2013 one and that wouldnt be right if you ask me!

The current tax year is 2012. So you submit that get tax transcript you could go to IRS office and have same day.

Call USCIS, when the script bot answers, and ask for a tier 2 human. Leave out "human."

The first person who answers the phone is a contract worker, paid to read off of a computer screen. They are generally not educated in immigration law.

"never ending hell" is so right, the request must be an error. Call them and request a tier 2, they have the ability to look further into your case and hopefully can resolve this for you. I am so sorry...Good luck.

You have to be smarter than the person answering the phone and cover every possible response.

When they say the "most recent year is 2013" you say DO YOU MEAN filed in 2013 for the 2012 tax year?

And if they say yes YOU SAY...We sent that with the packet do we need to send it again....

If they say no YOU SAY...how can we send in something that will not be filed for at least 2 months and is not a requirement for our adjustment of status...can I speak to someone higher up that may be able to tell me what I really need to do?

This is what I said and then the lady answer she is not able to provide more information and I have to go to www.justice.gov and find help there.

Can you believe this?

I am having my fingerprints appointment tomorrow and so I will try to find someone who can answer my questions.Thank you

If you didn't submit tax return transcripts in your AOS packet then I suggest you order one for 2012 and submit that - it contains all relevant tax information. If you did then maybe they lost it so order one again and re-submit.

My Immigration Journey:

K1: June 2010 - December 2010

AOS: April 2011 - June 2011

ROC: April 2013 - August 2013

Naturalization: March 2014 - August 2014

Most recent is 2012, and that is what they are asking for, as only the most recent tax return is required with the I-864. Now, did you send in a complete copy of your tax return with all forms, schedules, W-2s and or 1099s? It must be a complete copy of the return or an IRS tax return transcript. We are about to call tomorrow because it does not work online....

We did sent them the W-2 forms for the past 3 years...

Now hope it won't take forever to get this tax return transcript.

I am so down right now because this AoS process is getting really annoying, I want is to have back my "human rights" and be able to work and live like a normal person!

If you only sent the W-2s, then that is the problem and why you got an RFE for the tax return, It must be complete, not just the W-2.

I would just send the current year with a cover a letter including a copy of their letter

citing the I-485 requirements only. I've been working for the fed government for 38

years and they expect people to follow the instructions to the letter...I don't know why

that failed in your situation but this is what I would do. Do not wait until you file your

2013 taxes because the clock is running. What I have seen is that alot of people

try to do the over kill thing because of what someone else has done. My experience

is to do exactly what the forms tell you to do and you will be fine.
